Accordingly, in the past period, in implementing projects serving socio-economic development in the province, regarding difficulties and obstacles related to land reclamation and the disposal of excess materials, the Bac Kan Department of Natural Resources and Environment has advised the Provincial People's Committee to direct or provide guidance on each project or specific field related to land, minerals, and environment.

The disposal of excess soil, rocks, sand, gravel, and construction materials must comply with legal regulations.

To ensure a unified solution to difficulties and obstacles related to land reclamation and the disposal of excess materials during construction projects in the province, the Department of Natural Resources and Environment requests that units and localities implement the following:

Regarding the implementation of regulations on the exploitation and use of land, stone, sand, gravel, and fill soil for construction projects in the province (cases of exploitation within the area of ​​a construction project where the product only serves that project; cases of mineral exploitation within the area of ​​a construction investment project where the extracted product serves other projects; land recovery and the preparation of a land use plan after the completion of exploitation; and the method of submitting documents).

For earthworks and excavation activities, investors should study and implement the guidelines in Circular No. 43/HD-STNMT dated March 28, 2022, of the Department of Natural Resources and Environment on environmental protection in earthworks and excavation activities in Bac Kan province, and Circular No. 1189/STNMT-MT dated May 12, 2023, on temporary guidance for clearing landslide debris caused by natural disasters on transportation routes in the province (including surveying and selecting locations for dumping excess earth and rock; ensuring safety and environmental hygiene during the dumping process).

The coordinating units involved in the waste disposal, leveling, and excavation process include: the Department of Transport, the Department of Construction, the People's Committees of districts and cities, and the People's Committees of communes, wards, and towns.

During the implementation process, if any difficulties or obstacles arise, units are requested to exchange information with the Department of Natural Resources and Environment for consideration and specific guidance to suit the actual situation.
