The Ministry of Home Affairs has just provided guidance on the arrangement and use of non-professional staff at the commune level when implementing the two-level local government model.
The Ministry of Home Affairs has just issued Official Dispatch 4753/BNV-CQDP on resolving difficulties and problems in the process of implementing the 2-level local government model.
Accordingly, the People's Committees of provinces and cities are required to review, support and thoroughly resolve difficulties and problems in localities, especially those related to the arrangement, assignment and resolution of regimes and policies for cadres, civil servants, public employees and workers; arrangement of working offices; public disclosure and implementation of administrative procedures to serve people and businesses; archiving and digitizing documents... to ensure timeliness and efficiency, to avoid prolongation, delay and lateness, and to prevent the emergence of hot spots and disunity.
Regarding the arrangement and use of non-professional workers at the commune level when implementing the 2-level local government model, the Ministry of Home Affairs stated 2 bases.
Specifically, the Government Steering Committee issued Official Dispatch 12/CV-BCĐ on orientations for some contents on arranging and assigning non-professional staff at the commune level when implementing the 2-level local government model.
At the same time, the Government issued Decree 170/2025/ND-CP regulating the recruitment, use and management of civil servants, effective from July 1, which stipulates that part-time workers at the commune level are one of the subjects accepted to work as civil servants when meeting the standards and conditions for acceptance according to regulations.
In addition, the procedure for converting villages and residential groups and renaming villages and residential groups at newly formed commune-level administrative units after the arrangement follows the new regulations of the Law on Organization of Local Government 2025 (Law No. 72/2025/QH15).
The Ministry of Home Affairs also said that when implementing the arrangement, if cadres, civil servants and public employees wish to immediately quit their jobs, the local Party Committee and government will base on the Resolution of the National Assembly and the Standing Committee of the National Assembly on the arrangement of provincial and communal administrative units and the Master Plan on the arrangement of specialized agencies, administrative agencies and public service units when implementing the 2-level local government model of the locality to consider and decide to let cadres, civil servants, public employees and employees quit their jobs and immediately enjoy the policies and regimes according to Decree 178/2024/ND-CP (amended and supplemented in Decree 67/2025/ND-CP).
