When should businesses take up recycling responsibilities?

Time to implement recycling responsibility

According to Clause 4, Article 77 of Decree No. 08/2022/ND-CP, manufacturers and importers of products and packaging are responsible for recycling products and packaging according to the following roadmap:

- Batteries and rechargeable batteries: effective from January 1, 2024.

- Lubricants: Effective from January 1, 2024.

- Tires and tubes: Effective from January 1, 2024.

- Packaging: Implemented from January 1, 2024.

- Electricity - electronics: Implemented from January 1, 2025.

- Means of transport: Implemented from January 1, 2027.

Electricity and electronics will take on recycling responsibilities from January 1, 2025.

Cases where recycling responsibilities are not required

According to Clause 3, Article 77 of Decree No. 08/2022/ND-CP, in some cases, manufacturers and importers of products and packaging do not have to fulfill recycling responsibilities, including: Manufacturing products and packaging for export; Temporarily importing and re-exporting products and packaging; Manufacturing and importing for research, study and testing purposes (not for commercial purposes); Packaging manufacturers with sales and service revenue of the previous year of less than 30 billion VND; Packaging importers with total import value (calculated according to customs value) of the previous year of less than 20 billion VND.

Commercial packaging of lubricants, electricity and electronics

According to Article 77 and Appendix XXII of Decree No. 08/2022/ND-CP, manufacturers and importers of products such as lubricants, electricity - electronics, batteries, rechargeable batteries, and tires must fulfill their recycling responsibilities according to the required roadmap, rate and recycling specifications.

The packaging (commercial goods) of lubricants, electrical and electronic products, batteries, rechargeable batteries and tires are not included in the packaging group of products and goods specified in Clause 2, Article 77 of Decree No. 08/2022/ND-CP. Therefore, manufacturers and importers of lubricants, electrical and electronic products, batteries, rechargeable batteries and tires are not responsible for recycling the commercial packaging of these products.
