The Provincial People's Procuracy organizes the Contest "Skills in writing draft recommendations in investigation activities of the People's Procuracy" in 2023.

Good control of criminal field

Recently, the People's Procuracy of Vi Thuy district coordinated with the court of the same level to organize a mobile trial of the criminal case against defendant Nguyen Van Dung for the crime of illegal possession of drugs.

The indictment stated that at 9:30 a.m. on April 26, 2023, upon receiving a report from the public, Vi Thuy District Police conducted an inspection and caught Nguyen Van Dung, residing in Hamlet 5, Nang Mau Town, Vi Thuy District, in the act of illegally storing drugs in a pack of Jet brand cigarettes in the living room of Mr. Bui Van Giang, residing in Hamlet 8, Vi Thang Commune, Vi Thuy District...

During the investigation, Dung confessed that on the morning of April 24, 2023, Dung took a bus from Vi Thuy district to Ba market area, Thanh Phuoc ward, Binh Minh town, Vinh Long province, bought the above drugs from a man (unknown origin) for 300,000 VND, brought them to Dung's house to hide. On the morning of April 26, 2023, Dung went back to Giang's house, took out a portion of the drugs he brought with him to use, and was arrested.

At the trial, based on the assessment and analysis of the nature, extent, and consequences of the defendant's criminal acts and the documents and evidence examined at the trial, the Trial Panel sentenced defendant Nguyen Van Dung to 18 months in prison. At the end of the trial, the leaders and prosecutors of the Vi Thuy District People's Procuracy and the Trial Panel held a meeting to review the entire trial process.

According to the Provincial People's Procuracy, since the beginning of the year, the two levels of provincial procuracy have coordinated to organize more than 15 mobile trials, with the aim of improving trial skills, gaining experience in practicing the right to prosecute and supervise trials, and at the same time serving the propaganda and dissemination of law in the locality. The cases selected for trial are often complicated in nature and behavior; have the potential for litigation, thereby helping prosecutors improve their expertise, professionalism, and professional skills.

Mr. Ho Viet Thang, Deputy Director of the Provincial People's Procuracy, said: "Along with organizing experience-sharing sessions, the two levels of the provincial procuracy have implemented many measures to effectively perform the functions and tasks of the sector. Since then, the initiation, investigation, prosecution, trial and application of preventive measures have been in accordance with the law, with no cases of wrongful conviction or criminals being let go.

“Specifically, in the first 9 months of 2023, the industry has coordinated with investigation agencies and courts to identify 29 key cases to focus on investigation, prosecution, and trial to serve the local political tasks (an increase of 5 cases compared to the same period). Coordinated with the court to organize 17 online trials. Activities to practice the right to prosecute and supervise judicial activities during the investigation, prosecution, and trial of criminal cases continue to be strictly implemented, ensuring legal regulations,” Mr. Thang informed.

Building a team of professional inspectors

Innovation in personnel organization; building a streamlined apparatus with effective and efficient operations is identified as one of the key and breakthrough tasks of the provincial procuracy in 2023, and is also a key task in judicial reform that is focused on by the two levels of provincial procuracy.

Mr. Nguyen Thanh Liem, Chief Prosecutor of the Provincial People's Procuracy, said that in implementing judicial reform, the Party Committee of the Provincial People's Procuracy has directed the provincial prosecution sector to strictly implement the directives and resolutions of the Central and local governments to build a team of prosecutors who are politically steadfast, professionally proficient, knowledgeable in the law, impartial and courageous, disciplined and responsible.

Up to now, the entire Hau Giang Procuracy has 7 professional departments and 8 district, town and city People's Procuracies with 124 officers, prosecutors and workers. Of which, the two levels of procuracy currently have 90 prosecutors, including 38 intermediate prosecutors, 51 primary prosecutors; 6 civil servants with a master's degree in law, 108 people with a university degree in law...

According to Mr. Liem, in order to improve the quality of prosecutors' litigation, every year, the unit's leaders organize competitions such as "Skills in writing indictments and draft indictments", "Skills in presenting speeches of prosecutors", and recently, the unit organized the first competition "Skills in writing draft recommendations in the investigation activities of the People's Procuracy" in 2023. In addition, the industry has sent many officials and prosecutors to fully participate in training courses to improve their qualifications and professional skills organized by the Supreme People's Procuracy.

However, in the supervision of judicial activities since the beginning of the year, the sector has also encountered some difficulties and limitations. Specifically, there have been cases where the court returned the case file for further investigation; protests were not timely filed in some civil and commercial cases... The main reason for this situation is the increase in the number of cases compared to the same period last year, the increasingly complicated nature of the cases, and sophisticated criminal methods...

Mr. Nguyen Thanh Liem said: To overcome the above limitations and shortcomings, from now until the end of the year, the provincial Procuracy will continue to improve the quality of the work of supervising the settlement of criminal cases, ensuring the prosecution of the right person, the right crime, the right law, no wrongful convictions, no criminals are left at large. The sector also enhances the responsibility and skills of prosecutors at criminal and civil trials,... Strengthen inspection and examination of public services. Timely supervise judicial activities to detect violations and issue protests and recommendations, thereby ensuring the rule of law in judicial activities in the area.
