According to car manufacturers, seat belts in cars are one of the equipment to help people in the car reduce injuries and reduce the death rate in accidents. According to the manufacturer's design, when participating in traffic, seat belts will ensure that people in the car do not move their sitting position when the car changes speed suddenly. In particular, as the name suggests, seat belts will protect passengers more safely and not be thrown out in the event of a collision. Therefore, the mandatory regulation of wearing seat belts is something that people in the car must comply with to ensure their own safety.
According to Article 9 of the Consolidated Document 15/VBHN-VPQH of 2019, consolidating the Road Traffic Law issued by the Office of the National Assembly , people sitting in cars must wear seat belts in all positions where the car is equipped with seat belts to ensure safety while moving. Any position in the car equipped with seat belts that the driver or passenger does not wear will be fined, not just the driver.
According to Clause 3, Article 5 of Decree 100/2019/ND-CP, the violation of not wearing a seat belt will be specifically punished as follows:
- Drivers who do not wear seat belts while driving on the road and those who carry passengers in cars without wearing seat belts (in locations equipped with seat belts) while the car is moving will be fined from 800,000 VND to 1 million VND.
-People transported in cars who do not wear seat belts (where seat belts are equipped) while the car is moving will be fined from 300,000 VND to 500,000 VND.
For the violation of not wearing a seat belt, the offending driver will not be subject to the penalty of having his/her driver's license revoked.
According to the law, when punishing the violation of not wearing a seat belt, there is no need for photos as evidence. Traffic police can observe with their eyes, directly detect the violation and handle the violation.
However, in some cases, drivers often do not cooperate and demand to see the images. Therefore, most traffic police are now equipped with cameras to record while the vehicle is running as evidence for penalties to avoid wasting time when handling violations.
Notably, for the violation of not wearing a seat belt in a car, the driver will be forced to have a record drawn up according to the provisions of Article 56 of Consolidated Document 09/VBHN-VPQH on the Law on Handling of Administrative Violations and Sanctions for Administrative Violations.
