The US International Trade Commission (ITC) has just issued a final determination of injury in the antidumping/countervailing duty investigation of aluminum extrusions imported from China, Colombia, Ecuador, India, Indonesia, Italy, Malaysia, Mexico, South Korea, Taiwan (China), Thailand, Turkey, the United Arab Emirates and Vietnam.
Accordingly, the ITC determined that the US industry was not significantly injured by extruded aluminum imported from 14 countries/territories under investigation, although the US Department of Commerce had previously concluded that extruded aluminum imported from these countries/territories was dumped/subsidized.
Based on the conclusion of the USITC, DOC will not issue an anti-dumping/anti-subsidy order on aluminum extrusions imported from the above 14 countries/territories.
The case was initiated by DOC on October 24, 2023, in which Vietnam was only investigated for anti-dumping.
Under US investigation regulations, there are two agencies involved in an antidumping/countervailing duty investigation: DOC investigates dumping/subsidy and is responsible for the overall investigation results while ITC is responsible for assessing the injury to the domestic industry.
Products are only subject to anti-dumping/countervailing duties if both agencies issue affirmative determinations.
The US has been Vietnam's largest export market for many years, with export growth rates consistently at the top. However, this is the market with the most trade defense investigations into Vietnam's exports. Currently, a number of Vietnamese businesses and industries have gained a lot of experience in dealing with the incident.
Looking broadly at all export markets, it has been noted that in many cases, Vietnam has been successful in proving that businesses do not dump, the Government does not subsidize, and does not intervene in the market to create unfair advantages for businesses exporting to key markets such as the US, Canada, Australia, India, etc.
For example, in some cases where the US investigated anti-dumping against Vietnamese enterprises, most enterprises with large export proportions were not subject to anti-dumping tax (such as tra fish, basa fish, shrimp, and tires).
India, Malaysia, and Indonesia have also successively ended anti-dumping investigations into MDF, PET plastic, and cold-rolled steel... as a result, exporting enterprises are not subject to defense taxes or are subject to low taxes, contributing to maintaining and expanding export markets.
