This unexpected move suggests that the most advanced US AI chips may still be reaching overseas subsidiaries of Chinese AI companies, such as in Malaysia, despite Washington's efforts to restrict access to critical semiconductors used in AI technology development.

It is unclear how many chips have been exported over the past year through the aforementioned channels. However, estimates suggest the number could be in the hundreds of thousands.
In new guidance, the Bureau of Industry and Security (BIS) of the U.S. Department of Commerce stated that sales of advanced AI chips to businesses or organizations based in China will require a license, even if those entities operate overseas.
“BIS has issued guidance clarifying export licensing requirements that took effect in 2023. BIS will continue to rigorously enforce export controls to protect critical U.S. technologies,” a spokesperson for the agency said.
An Nvidia representative said the new guidance does not change the company's operations because the U.S. Department of Commerce had previously imposed licensing requirements for the export of the company's advanced AI chips.
This loophole emerged after the US Department of Commerce announced in May 2025 that it would not enforce the AI export control regulations of former President Joe Biden, which were designed to restrict the access of advanced US AI technology to entities controlled by Washington.
This regulation sets out licensing requirements related to global access to AI chips.
