Decree on petroleum business is slow to be amended, retail businesses ask to meet the Prime Minister

On July 3, hundreds of petroleum retail businesses authorized Mr. Giang Chan Tay - Director of Boi Ngoc LLC ( Tra Vinh ) to represent and send a petition to the Prime Minister reporting on the business situation and petitions related to the decree on petroleum trading.

Some issues raised by retail businesses in the petition are that they have not received the standard costs and standard profits of petroleum retail businesses as stipulated in Decree 95 on petroleum business of the Government and Circular 104 of the Ministry of Finance and the Deputy Prime Minister has directed to consider refunding... The petition states: "The regulations do not clearly state the ratio of dividing these amounts at each stage, so the main businesses have collected all of them when they have losses and when they have profits, they have compensated for the losses of the previous period that have not been fully compensated, even compensating for losses due to investment in business outside the industry".

Therefore, retail businesses propose that the revised decree should clearly stipulate standard costs, the ratio of dividing standard business costs and standard profits at each stage, clearly state the maximum wholesale price, and allow businesses to set their own selling prices...

According to retail businesses, at the beginning of this year, in Directive 03, Prime Minister Pham Minh Chinh requested the Ministry of Industry and Trade to urgently submit to the Government a draft decree amending the petroleum business. Then, at the end of February, the Government Office sent an official dispatch conveying the opinion of Deputy Prime Minister Le Minh Khai on assigning the Ministry of Industry and Trade to preside over and urgently submit to the Government a draft Decree on petroleum and emphasized "without delay". Recently, on April 17, Deputy Prime Minister Le Minh Khai continued to request the Ministry of Industry and Trade and the Ministry of Finance to study the recommendations of retail businesses on ensuring costs and profits of petroleum business and respond to petroleum retail businesses.

On May 15, retail businesses sent a petition to the Prime Minister requesting the issuance of a Decree amending Decrees 83 and 95 on gasoline no later than the second quarter of 2023.

However, by now, the second quarter has ended, and the urgent instructions of the Deputy Prime Minister and the Prime Minister to relevant ministries and branches have not yet seen any movement. In particular, both the Ministry of Industry and Trade and the Ministry of Finance have not yet responded to the consideration of refunding the standard business costs and standard profits as directed by the Deputy Prime Minister.

Therefore, a number of petroleum retail enterprises representing hundreds of petroleum retail enterprises nationwide "request to meet and report to the Prime Minister on the difficult situation of petroleum retail enterprises; propose necessary contents to be amended in the revised decree on petroleum trading; at the same time hope that the Prime Minister will soon issue a revised decree to help the petroleum industry turn to a new page of stability, efficiency, fairness, ensuring national energy security, especially reducing difficulties for enterprises in general and retail enterprises in particular...".

In the latest draft Decree amending the Decree on petroleum business, the Ministry of Industry and Trade also introduced a number of new points such as: allowing retail businesses to get goods from many sources, adjusting the price management period from 10 days to 7 days, businesses are proactive in selling prices...
