Pursuant to the State Budget Law dated June 25, 2015;

Pursuant to the Land Law dated January 18, 2024; Law on Amending and Supplementing a Number of Articles of the Land Law No. 31/2024/QH15, Housing Law No. 27/2023/QH15, Law on Real Estate Business No. 29/2023/QH15 and Law on Credit Institutions No. 32/2024/QH15, dated June 29, 2024;

Pursuant to Decree No. 163/2016/ND-CP dated December 21, 2016 of the Government detailing the implementation of a number of articles of the State Budget Law;

Pursuant to Decree No. 112/ND-CP dated September 11, 2024 of the Government detailing regulations on rice-growing land;

Considering Submission No. 176/TTr-UBND dated November 18, 2024 of the Provincial People's Committee on promulgating the Resolution of the Provincial People's Council regulating the principles, scope, support levels and use of support funds related to rice-growing land in Nam Dinh province according to the provisions of Clause 2, Article 15 of Decree No. 112/2024/ND-CP dated September 11, 2024 of the Government; Verification report of the Economic - Budget Committee of the Provincial People's Council; discussion opinions of the Provincial People's Council delegates at the session.

RESOLUTION:

Article 1. Scope of regulation and applicable subjects

1. Scope of adjustment

This Resolution stipulates the principles, scope, support levels and use of support funds related to rice-growing land in Nam Dinh province according to the provisions of Clause 2, Article 15 of Decree No. 112/2024/ND-CP dated September 11, 2024 of the Government.

2. Applicable subjects

State agencies, users of rice-growing land and other entities related to the management and use of rice-growing land as prescribed in Article 1 of Decree No. 112/2024/ND-CP dated September 11, 2024 of the Government.

Article 2. Principles and scope of support

The total amount of funds allocated or leased by the State for non -agricultural use from land dedicated to rice cultivation must be paid according to the provisions of Clause 1, Article 12 of Decree No. 112/2024/ND-CP and the State budget funds to support rice production in the local budget balance expenditure estimate according to the provisions of Clause 1, Article 14 of Decree No. 112/2024/ND-CP are allocated and arranged for use for the purpose of supplementing lost specialized rice cultivation areas or increasing the efficiency of rice land use; supporting localities in production, protecting rice cultivation land, applying modern science and technology to rice cultivation planning areas with high productivity and quality.

Article 3. Support levels and use of support funds

1. Support rate

a) For the funding source that the person who is allocated land or leased land by the State for non-agricultural purposes from land specialized in rice cultivation must pay according to the provisions of Clause 1, Article 12 of Decree No. 112/2024/ND-CP: Support 100% of the funding for districts and cities corresponding to the amount of revenue paid to the State budget of this funding arising in the areas of districts and cities.

b) For the State budget source to support rice production in the local budget balance expenditure estimate as prescribed in Clause 1, Article 14 of Decree No. 112/2024/ND-CP: Support funding for districts and cities according to the norms prescribed in Clause 1, Article 14 of Decree No. 112/2024/ND-CP.

2. The funding source in Clause 1 of this Article shall be used for the activities specified in Clause 2, Article 15 of Decree No. 112/2024/ND-CP.

Article 4. The Provincial People's Committee is assigned to organize the implementation of the Resolution.

Article 5. The Standing Committee of the People's Council, the Committees of the People's Council, the People's Council Delegation Groups and the provincial People's Council delegates shall supervise the implementation of the Resolution.

This Resolution was passed by the 19th Nam Dinh Provincial People's Council, 22nd Session on December 10, 2024 and takes effect from December 10, 2024.
