However, Ms. Do Thi Lan Chi also noted that when having a traffic accident on the way to work, to enjoy the benefits of a work accident, the employee must prove that this is a work accident, on a reasonable distance and time. At that time, the employee needs to notify the employer, do some procedures such as timely first aid, the employer will advance the money during the emergency; pay medical expenses, hospital fees; pay salary during the work accident; compensation for work accidents; allowances for people with work accidents...
In addition, after the treatment period is stable, the employer must send the employee for a health check-up to receive the benefits related to the employer's payment. Accordingly, the file for receiving occupational accident benefits includes the following documents: Social insurance book; Hospital discharge papers or copies of medical records after occupational accident treatment for inpatients; Minutes of assessment of the level of reduced working capacity by the Medical Assessment Council; and a document requesting settlement of occupational accident benefits.
However, not all traffic accidents on the right route and at the right time are eligible for benefits, but also depend on the cause of the accident. For example, if the employee is intentional, has a personal conflict with the person causing the accident, or uses prohibited substances, etc., they will not be eligible for benefits.
