This is the fourth draft decree to be issued and consists of 5 chapters and 25 articles.
Which officers will be encouraged to protect?
The draft stipulates that the subjects of application are cadres, civil servants, leaders and managers in state administrative agencies and organizations, managers in public service units, people holding titles and positions and representatives of state capital in enterprises according to regulations of the Government and relevant agencies, organizations and individuals.
The draft clearly states the principles and conditions to encourage and protect cadres who are dynamic, creative, dare to think, dare to do, and dare to take responsibility for the common good.
In which, officials with innovative and creative proposals are encouraged and protected, and their implementation is considered and decided upon by the agency employing the officials within the scope of their decision-making authority as prescribed by law, ensuring that they do not violate Party regulations, legal documents of the National Assembly , the National Assembly Standing Committee, superior state agencies, and international treaties to which Vietnam is a member.
The encouragement and protection of cadres must be carried out promptly, democratically, publicly, transparently, with the right subjects, in the right order and procedures according to the provisions of this Decree and relevant laws.
Active and creative cadres for the common good may not be held responsible, and may be exempted, exempted or have their responsibilities reduced according to the provisions of the draft...
The draft also devotes a chapter to regulating the order, procedures and approval of innovation and creativity proposals of officials.
How to encourage and protect cadres who dare to think and dare to do?
Regarding the policy of encouraging cadres, the draft clearly states that they will be commended and praised before the collective agency or unit, and will be rewarded according to the provisions of the law on emulation and rewards for proposals that are assessed as completed.
Used as a basis for assessment before classification, appointment, re-appointment, planning, transfer, rotation in the direction of prioritizing the arrangement and use of cadres with innovative thinking, creative working methods, and high efficiency.
Be assessed as having excellent achievements in public service activities to be considered for promotion to civil servant rank; be considered for salary increase 12 months ahead of schedule according to the provisions of law for innovative and creative proposals that are assessed as completed.
Be motivated and encouraged in other forms in accordance with Party regulations and State laws.
The cadres, individuals and organizations implementing the proposal, depending on the specific case, will be promptly provided with equipment, working means, human resources and funding by the agency employing the cadre to ensure the implementation of the approved proposal.
Regarding protection measures, according to the draft, officials implementing innovation and creativity proposals in certain cases will not be held responsible according to relevant legal provisions.
Officials who propose innovation and creativity but do not complete or only partially complete the set goals but are reviewed and evaluated by the agency employing the official as having implemented the policy correctly, with pure motives, and for the common good will be exempted from responsibility according to the provisions of relevant laws.

The draft stipulates measures to protect agencies, organizations and individuals, along with regulations on handling violations.
The draft also has a separate chapter defining the responsibilities of officials and agencies in proposing and implementing proposals. Along with that is a chapter on implementation./.
