National Assembly deputies vote to pass the Law on Chemicals (amended)
Previously, Chairman of the Committee on Science , Technology and Environment Le Quang Huy presented a report explaining, accepting and revising the draft Law on Chemicals (amended).
Accordingly, there are opinions suggesting removing the content on the Chemical Industry Development Strategy in the draft Law; studying and perfecting the provisions related to the Chemical Industry Development Strategy.
Regarding this content, the Standing Committee of the National Assembly found that building a strategy for developing the chemical industry is necessary to contribute to implementing the Party's Resolutions on developing the basic industry, including chemicals.
The Draft Law stipulates the chemical industry development strategy to provide a legal basis for the development and implementation of the strategy. The approved chemical industry development strategy is the basis for developing relevant contents of regional and provincial planning and is the basis for deciding on investment policies or approving investment policies for chemical projects.
In addition, taking into account the opinions of the National Assembly Deputies, the draft Law has revised and supplemented the requirement on "sustainable development" at Point c, Clause 2, Article 4. Accordingly, to meet the requirements of sustainable development, the development of the chemical industry is aimed at the efficient use of natural resources, focusing on environmentally friendly chemicals.
To ensure specific and feasible regulations in practice, the draft Law has been revised and consolidated into one article regulating the chemical industry development strategy (Article 4), including regulations on requirements for the strategy; main content of the strategy; strategy formulation stage; authority to approve and adjust the strategy.
The draft Law has also been revised, removing regulations on the responsibilities of the strategy-making agency in consulting and announcing the strategy; funding for developing and organizing the implementation of the strategy; and assigning the Government to specify these contents in detail.
There are suggestions to add measures to trace origin, manage production and transportation through electronic invoices and product traces.
Regarding this content, the Standing Committee of the National Assembly noted that the draft Law has a number of provisions for tracing the origin of chemicals, specifically: organizations trading in chemicals requiring special control must comply with the provisions on the preparation of Control Sheets for the purchase and sale of chemicals requiring special control and must have their data on the purchasing and selling organizations and individuals authenticated according to the implementation roadmap prescribed by the Government (Clause 4, Article 11); organizations and individuals using chemicals requiring special control must declare the type of chemical and the purpose of using the chemical on the Chemical Specialized Database before using it for the first time or before changing the purpose of use (Point b, Clause 2, Article 15). The above provisions have ensured strict management of chemical activities and the ability to trace the origin of chemicals. Therefore, the Standing Committee of the National Assembly proposed to keep it as in the draft Law.
There are suggestions to build, support and develop the chemical industry towards green chemistry and circular economy. Regarding this content, the Draft Law has stipulated the application of green chemistry principles including 12 principles to minimize the impact of chemicals on the environment and human health.
The application of green chemistry principles is necessary to achieve sustainable development goals, contributing to the implementation of Conclusion No. 81-KL/TW dated June 4, 2024 of the Politburo to promote the implementation of green transformation and circular economy.
Currently, some green chemistry principles have been applied in many projects (such as energy saving, incident prevention, etc.). The application of green chemistry principles will be regulated and specifically guided by the Government according to the provisions of Clause 5, Article 5 of the draft Law.
