New perspective "unleashes" state-invested enterprises

Through the approach to the draft Law on Management and Investment of State Capital in Enterprises, experts highly appreciate the viewpoint of law making that establishes the principle: The State is identified as a special capital investor in enterprises, not directly intervening administratively in the production, business and management activities of enterprises.

The State manages investment capital flows through agencies and representatives of capital owners at enterprises to ensure the rights of capital investors and capital contributors to enterprises. Currently, the Ministry of Finance , as the drafting agency, is urgently collecting opinions, supplementing and perfecting the law to achieve the highest efficiency.

Deputy Prime Minister and Minister of Finance Ho Duc Phoc emphasized that this is an important Law project that creates momentum for State-owned enterprises to develop in the coming time.

"State-owned enterprises must create breakthroughs in development, as the leading birds in difficult and creative fields. Accordingly, legal regulations must create the best enterprises for leaders of enterprises with State capital to promote the development process, autonomy, self-determination, and self-responsibility for economic development. Therefore, the policy is to enhance proactive flexibility, increase decentralization, and 3. take into account the final efficiency to ensure the dynamism of enterprises" - Deputy Prime Minister, Minister of Finance Ho Duc Phoc clearly stated.

Along with the development of the economy, the development of the Law on Management and Investment of State Capital in Enterprises, replacing the Law on Management and Use of State Capital Invested in Production and Business at Enterprises (Law No. 69) is very necessary. It is expected that the Law on Management and Investment of State Capital in Enterprises will be given the first opinion by the 15th National Assembly at the 8th session (October 2024), approved at the 9th session (May 2025) and will take effect from January 1, 2026.
