According to regulations, the area of public land considered for separation into an independent project must meet specific criteria regarding scale and proportion for each locality. In Hai Chau, Hoa Cuong, Thanh Khe, An Khe, An Hai, and Son Tra wards, the separation ratio must be 10% or more of the total project land area, with a minimum area of 150m2. In Ngu Hanh Son, Hoa Khanh, Lien Chieu, Cam Le, and Hoa Xuan wards, the ratio must be 10% or more, with a minimum area of 200m2.
In Tam Ky, Hoi An, and Hai Van wards, the rate must be 10% or higher, with a minimum area of 300m2. In Ban Thach, Quang Phu, Huong Tra, Hoi An Dong, Hoi An Tay, Dien Ban, Dien Ban Dong, An Thang, and Dien Ban Bac wards, the rate must be 15% or higher, with a minimum area of 500m2. In communes and special zones, the rate must be 20% or higher, with a minimum area of 2,000m2. For difficult and extremely difficult areas, the minimum areas are 3,000m2 and 5,000m2 respectively.
For projects located across two or more communes or wards, the criterion of the area with the larger proportion of public land will apply. In the case of project expansion, the ratio and area will only be calculated based on the public land within the expanded area. For golf course projects specifically, the proportion of public land must be 50% or more of the total land area.
