I am the Vice Principal of a primary school, and also the President of the Trade Union. During the school year, I teach 4 periods/week as required. According to Circular No. 08/2016/TT-BGDDT, school management staff (Principals, Vice Principals) who do non-professional trade union work must still teach the required number of teaching hours.

According to the provisions of Clause 4, Article 8 of Circular No. 05/2025/TT-BGDDT dated March 7, 2025 of the Ministry of Education and Training , the working regime for general education teachers, university preparatory teachers, Principals and Vice Principals cannot be converted to reduce the teaching hour norm for concurrent tasks in place of the teaching hour norm.
At the same time, according to the provisions of Clause 4, Article 4 of Circular No. 08/2016/TT-BGDDT, Principals and Vice Principals who do non-professional trade union work must still teach the required number of teaching hours according to regulations. If the time spent concurrently doing trade union work leads to the total working time exceeding the prescribed norm, they will be entitled to overtime pay according to current regulations.
Joint Circular No. 07/2013/TTLT-BGDĐT-BNV-BTC dated March 8, 2013 on overtime pay regime clearly states the principle: “Overtime pay shall only be paid in units or departments lacking teachers as approved by competent authorities. In cases where there is no shortage of teachers, payment shall only be made when someone is absent due to illness, maternity, schooling, or other duties and is assigned by competent authorities and needs another teacher to teach instead.”
To be eligible for extra teaching hours due to concurrent union work, you need to clarify the total actual working hours, based on the teacher payroll situation at the school and report to the Principal for specific instructions. The school will review the documents, compare the regulations and establish procedures to request the management agency to approve payment if eligible.
