Regulations on technical safety inspection and environmental protection of road motor vehicles

The Ministry of Transport has just issued Circular No. 08/2023/TT-BGTVT amending and supplementing a number of articles of Circular No. 16/2021/TT-BGTVT dated August 12, 2021 of the Minister of Transport regulating technical safety and environmental protection inspection of road motor vehicles.

Regulations related to vehicles exempted from first inspection

Circular 08/2023/TT-BGTVT clearly stipulates: Exemption from first-time inspection is when the inspection unit bases on the Factory Quality Inspection Certificate or Certificate of Technical Safety and Environmental Protection Quality of Imported Motor Vehicles or Notice of Exemption from Technical Safety and Environmental Protection Quality Inspection of Imported Motor Vehicles and related documents as prescribed in this Circular to establish vehicle records, manage, store according to regulations and issue Inspection Certificates and Inspection Stamps without having to inspect and evaluate the vehicle.

At the same time, update data with the content "vehicle has performed the first inspection exemption" to the inspection management program of the Vietnam Register.

If the motor vehicle has been issued a Certificate and a first inspection stamp, the issuance of the Inspection Certificate and Inspection Stamp will be refused.

In case the motor vehicle only has an Appointment Paper for Vehicle Registration, the inspection unit shall issue the First Inspection Stamp and at the same time issue an Appointment Paper for Return of Inspection Certificate to the vehicle owner according to the prescribed form.

When the vehicle owner presents the Vehicle Registration Documents (Original Vehicle Registration Certificate issued by a competent state agency or original Receipt of holding the original Vehicle Registration Certificate (with a copy of the vehicle registration certificate) being mortgaged by a credit institution or Copy of the vehicle registration certificate certified by a financial leasing organization), the inspection unit will photocopy this type of document to keep in the vehicle file, inspection file and return the Inspection Certificate.

The above specific regulations according to the Vietnam Register aim to clearly assign responsibilities to the inspection center, ending the situation of refusing to perform services for vehicles exempted from first-time inspection as reported by the press.

In addition, the Circular also clearly stipulates that for motor vehicles with yellow license plates, black letters and numbers, and license plate series using one of the letters A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z, a Certificate of Inspection and Inspection Stamp for motor vehicles used for transportation business will be issued.

In other cases, the Inspection Certificate and Inspection Stamp are issued according to the vehicle owner's declaration.

Automatic extension of inspection cycle for vehicles with less than 9 seats that are not used for transportation business

Accordingly, in case the Inspection Certificate and Inspection Stamp of a non-commercial passenger car with up to 9 seats (with a production period of up to 7 years and a production period of 13 to 20 years) were issued before March 22, 2023 and are valid until July 1, 2024, they will continue to be used until the end of the period calculated according to the cycle prescribed in Appendix V of this Circular. The validity period of the Inspection Certificate and Inspection Stamp is confirmed by the Vietnam Register according to the form prescribed in Appendix VI issued with this Circular (the electronic copy is digitally signed by the Vietnam Register and has a QR-Code connecting to the Vietnam Register's website). The vehicle owner shall look up on the Vietnam Register's website (https://giahanxcg.vr.org.vn), print the Certificate of validity of the Inspection Certificate and Inspection Stamp. This certificate is an inseparable accompanying document of the Inspection Certificate issued for participation in road traffic according to regulations.

This provision does not apply to cases where the Inspection Certificate and Inspection Stamp expire before the effective date of this Circular.

Clearly define responsibilities and raise vehicle owners' awareness of vehicle maintenance.

The Circular also clearly stipulates the responsibilities of vehicle owners during the period between two inspection cycles to improve vehicle quality and ensure traffic safety.

Accordingly, vehicle owners and drivers are responsible for maintenance and repair to ensure the technical condition of the vehicle is maintained, and are responsible according to the provisions of law for the act of putting vehicles that do not meet technical safety and environmental protection standards on the road.

In case the inspection unit discovers that the Certificate and Inspection Stamp are counterfeit or erased or modified, it shall make a record of the revocation and transfer it to the police agency for handling according to the provisions of law. At the same time, report to the Vietnam Register and immediately enter the violation information into the inspection management program.

Regarding the form of receiving registration for inspection, the Circular adds regulations that the inspection unit receives registration through one of the following forms: directly, by phone, on the website, or via the online registration application for motor vehicles when the vehicle owner has a need.

For vehicles that fail the first inspection, the inspection unit must warn on the inspection management program about the vehicle's defects and damage so that other inspection units can carefully inspect the vehicle when re-inspecting it a second time, helping to increase the effectiveness of vehicle inspection, improve vehicle quality as well as the responsibility of the vehicle owner.

In case a motor vehicle is re-inspected on the same working day at the same inspection unit, the inspection unit will only re-inspect the items that fail.

Particularly for items related to the brake system or steering system, if any item fails, all items of the corresponding brake system or steering system must be re-checked.

In case of re-inspection on another day or at another unit, all items must be re-inspected.

This Circular takes effect from June 3, 2023.
