Notice to the people 7 days before the election
The Government has just issued Decree No. 59/2023/ND-CP guiding the Law on Implementing Democracy at the Grassroots Level, which includes regulations on the process of electing village heads and residential group heads.
Regarding preparation work, the Chairman of the Commune People's Committee issued a decision to organize the election of village chief and residential group leader.
This unit, together with the Standing Committee of the Vietnam Fatherland Front Committee at the commune level, develops a plan, provides professional guidance, and organizes the implementation of the plan at least 20 days before the date of the community meeting to elect the village chief and head of the residential group.
Issue a decision to establish an Election Committee at least 10 days before the date of the community meeting to elect the village chief and residential group leader after agreeing with the Vietnam Fatherland Front Committee at the commune level.
Decisions must be announced to the people in the village and residential group, posted at the cultural house, community activity house of the village, residential group and announced on the public address system... at least 7 days before the election day.
The head of the Front Working Committee in the village or residential group organizes a meeting of the Front Working Committee in the village or residential group to plan a list of candidates for village chief or residential group head.
This unit reports to the village party committee and residential group to unanimously recommend at least one person to run for village chief or residential group leader.
Organize a meeting of the Front Working Committee in the village or residential group after receiving opinions from the village or residential group Party cell to decide on the official list of candidates (at least 1 person).
The election committee convenes and chairs the meeting to elect the village chief and the head of the residential group.
The meeting chair announces the reason, introduces the delegates; approves the meeting agenda; and introduces the meeting secretary.
Representatives of the Front Working Committee in the village or residential group introduce the list of candidates that the Front Working Committee in the village or residential group has agreed with the Party Committee of the village or residential group and request representatives of households attending the meeting to self-nominate/nominate qualified candidates to participate in the election.
2 forms of voting
Choose to vote by show of hands or secret ballot for participants to choose.
When voting by show of hands, the voting results are counted at the time of voting and recorded in the meeting minutes.
Voting by secret ballot, the meeting chair proposes the number and list of the Ballot Counting Committee of 3 to 5 people (including the Head of the Committee and members) for the household representatives attending the meeting to vote by show of hands.
The Counting Committee shall provide instructions on the rules, how to record and vote, and shall distribute the ballots. After the voting is over, the Counting Committee shall count the ballots and make a record of the vote count. The Head of the Counting Committee shall announce the vote count results at the meeting.
The meeting chair announces the voting results for each voting content and concludes the meeting. The decision of the residential community is expressed in the following written forms: Resolution, meeting minutes, memorandum, and agreement of the residential community, clearly stating the content of the decision of the residential community.
Immediately after the meeting ends, the meeting chair is responsible for completing the meeting records. No later than 5 working days from the end of the meeting, the decision approved by the community must be sent to the People's Committee at the commune level and the Vietnam Fatherland Front Committee at the commune level.
What is the allowance?
In Clause 2, Article 34 of Decree 33/2023/ND-CP, the Government details the allowance regime for part-time workers in villages and residential groups from July 1.
Accordingly, in villages and residential groups, there are no more than 3 positions including Party cell secretary, village chief or residential group leader, and head of the Front Work Committee.
These three positions receive monthly allowances. In addition, those directly involved in activities in villages and residential groups will also receive monthly support.
Compared to the old regulations, Decree 33/2023/ND-CP not only increases the allowance fund level for non-professional workers in villages and residential groups (from 1.0 - 1.5 times depending on each locality) but also adds two more localities that enjoy the allowance level of 6 times for residential groups with 500 households or more and villages with 350 households or more converted into residential groups due to the establishment of commune-level urban administrative units.
This is only the general allowance fund level for positions including village chief and residential group leader. To know exactly how much allowance each village chief and residential group leader is entitled to in this fund, it is necessary to consider the decision of the People's Council at the same level.
However, the decision on the allowance level for each subject must ensure correlation with the salary level 1 of commune-level civil servants with the same training level.
