The People's Committee of Cam Lam district, Khanh Hoa province has just sent a report to the Department of Natural Resources and Environment on the problems and proposed solutions for handling 114 land plots (divided into 2,385 land plots) that the People's Committee of Khanh Hoa province concluded were violations since June 2022.

Currently, Khanh Hoa Provincial People's Committee is coordinating with ministries and branches to complete the "Cam Lam New Urban Master Plan Project, Khanh Hoa Province to 2045" (abbreviated as Cam Lam Project) with a total area of over 54,719 hectares, belonging to 14 administrative units of Cam Lam district. According to Resolution 09 of the Politburo , Cam Lam district becomes a modern, ecological, international-class airport urban area.
However, in the past, this district was "hot" about the situation of dividing and selling land plots. Specifically, on June 10, 2022, Khanh Hoa Provincial People's Committee issued Conclusion No. 247 showing that from the beginning of 2018 to June 30, 2021, Cam Lam district allowed 114 areas to donate land for road construction to separate plots and divided a total of 2,385 plots in violation of regulations with a total area of about 55 hectares, "donating" to build roads over 97,400 m2.
The situation of dividing and selling land plots causes land fever in Cam Lam district with many violations.
Implementing the conclusion on handling violations, Cam Lam District People's Committee has canceled the decision to change land use purpose and the document approving investment in traffic roads; some land plots have canceled the document approving investment in traffic roads, but have not canceled the decisions to change land use purpose (because they are consistent with the types of planning maps and land use plans for 2020 of the district that have been approved)...
At the same time, Cam Lam District People's Committee has issued an official dispatch requesting the Cam Lam Branch Land Registration Office to temporarily suspend the implementation of land change registration procedures for the above-mentioned land plots; not allowing new construction in these areas... to rectify the situation of illegal subdivision and sale of land plots.

Mr. Ngo Van Bao, Chairman of Cam Lam District People's Committee, said that the land registration procedures for 2,385 plots of land in 114 areas have been temporarily suspended to limit the subdivision and sale of land in the district. However, the suspension of people's rights is not in accordance with the provisions of the law. Currently, there are many complaints, petitions and petitions related to this matter. The District People's Committee has received 84 complaints from households.
Specifically, Ms. D.THL (residing in Hung Yen province), a resident who bought 3 plots of land that were temporarily suspended from change, said that the residents bought the land with proper documents, and were then granted a land use right certificate. The land has a clear origin and is in accordance with the planning, but why can't it be built on? If they want to transfer or exercise inheritance rights, why can't it be done in accordance with the law?
Khanh Hoa Provincial People's Committee in Official Dispatch No. 220/UBND-XDND, dated April 18, 2023, assigned the District People's Committee to resolve the problem of temporarily suspending land change registration procedures for 114 land plots donated for road construction in Cam Lam district. Accordingly, on April 27, Cam Lam District People's Committee issued an official dispatch on ending the temporary suspension of land change registration. The reason is that the temporary suspension of land change registration after people have been granted land use right certificates is not in accordance with the provisions of the Land Law, the Civil Procedure Law, etc.
However, Cam Lam District People's Committee said that after canceling the documents approving investment in traffic roads, there are no specific instructions on what the next steps will be as well as how to resolve issues arising after canceling the documents approving construction of traffic roads. Therefore, Cam Lam District People's Committee has proposed the Department of Natural Resources and Environment to consider, synthesize and advise the Provincial People's Committee to allow people to build houses if they have a need for 7 areas donating land for traffic roads in accordance with the approved traffic planning.
For the remaining 107 areas where land is donated for road construction but is not in accordance with the traffic planning, the District People's Committee will cancel the documents approving road investment; propose to temporarily allow the existence of the above land plots according to the purpose stated on the land use right certificate. However, construction will not be allowed until it is in accordance with the detailed planning and meets the infrastructure conditions or there is a document from the competent authority permitting.
Regarding the opinion of Cam Lam district, the Department of Natural Resources and Environment of Khanh Hoa province said that this is an unprecedented issue. Therefore, the department will have a meeting with the district to review and discuss based on the district's review. Then, propose a solution and advise the Provincial People's Committee to submit to the Standing Committee and the Standing Committee of the Provincial Party Committee for consideration.
8 officials and leaders were disciplined
Regarding the violations in the guise of donating land for road construction and land subdivision and sale, the Provincial Party Committee Standing Committee decided to discipline the Standing Committee of Cam Lam District Party Committee for the 2015-2020 and 2020-2025 terms with a warning. Eight officials and leaders of Cam Lam District in the two aforementioned terms were disciplined and removed from all positions in the Party and government for their involvement in these violations.
