In the field of personal data protection, although Vietnam has issued Decree No. 13/2023/ND-CP, its implementation still faces many challenges. Many small and medium-sized enterprises do not fully understand and lack the resources to comply. In the field of cross-border data management, storage on foreign servers is quite common, while regulations on transferring data abroad and requiring servers to be located in Vietnam (according to Decree No. 53/2022/ND-CP) continue to cause difficulties for businesses.

In the field of goods traceability management, although the Ministry of Science and Technology has issued Circular No. 02/2024/TT-BKHCN (effective from June 1, 2024), the guidance of competent authorities and implementation by enterprises are still not thorough, causing the situation of goods of unknown origin to be widespread.

Another obstacle is the habit of manual paperwork, reluctance to use new systems, while customers are not familiar with electronic contracts or online searches, making the digital transformation process of businesses not as effective as expected.

Digital transformation requires large costs for infrastructure, equipment, software, cloud services, specialized personnel, and maintenance expenses such as maintenance, upgrades, and training - which are not small difficulties for businesses.

From the perspective of a business providing traceability solutions using RFID electronic chips - an important part of the national digital transformation program, Mr. Pham Van Tho, Chairman of the Board of Directors of Vietnam Anti-Counterfeiting Technology Joint Stock Company (ACTIV), said: The practice of applying digital technology in Vietnam is developing rapidly, but the legal system has not kept up.

In addition, the number of small and medium enterprises is increasing rapidly, but business owners lack legal knowledge, so they do not fully comply. Digital transformation requires large costs for infrastructure, equipment, software, cloud services, specialized personnel, and maintenance costs such as maintenance, upgrades, and training - which are not small difficulties for businesses.

From the perspective of the management agency, Mr. Pham Van Quan, Deputy Director of the Department of Industry ( Ministry of Industry and Trade ), said that the digital infrastructure and technology ecosystem in the country are not yet complete. The AI ​​infrastructure is still weak, lacking big data and a strong computing platform for development on an industrial scale.

Information security and safety issues are also challenges as more and more devices and lines are connected to the internet, increasing the risk of data leaks and cyber attacks, requiring the State to issue appropriate management standards and regulations.

In addition, awareness of digital transformation among businesses is not uniform; some are still afraid of changing technology due to lack of information or fear of risks, so they need support and guidance from management agencies.

Untie the knot

According to Ms. Mai Thi Thanh Oanh, Deputy General Director of Coc Coc Limited Liability Company, the State needs to continue removing legal barriers, ensuring fair competition between domestic digital platforms and international technology corporations, while maintaining the requirement that Vietnamese data be stored in Vietnam; there needs to be policies to support businesses connecting with institutes and schools to develop high-quality technology human resources, both professionally skilled and knowledgeable about the market.

According to Ms. Le Thu Hang, Deputy Head of Business Consulting Department (Hanoi Center for Investment Promotion and Enterprise Support), the private enterprise sector still faces many barriers in accessing capital, resources, technology and supporting infrastructure. Therefore, the early completion of policies, removal of mechanisms, and removal of barriers to unleash capacity and create breakthroughs for this economic sector is of great significance in enhancing the internal competitiveness of Vietnamese enterprises.

In reality, to synchronize the law and practice, the State needs to continue to issue more detailed and flexible documents to keep up with the pace of technological development.
