There will be an E-Commerce Law to tighten online trading and effectively fight counterfeit goods.

(Chinhphu.vn) - Faced with the increasingly sophisticated and complicated situation of counterfeit goods, fake goods, and trade fraud, Minister of Industry and Trade Nguyen Hong Dien said that in the coming time, the Ministry will advise the Government to submit to the National Assembly the Law on E-commerce to tighten management of online trading activities and strictly handle violations.

Minister of Industry and Trade Nguyen Hong Dien explained and clarified a number of issues raised by National Assembly deputies.

On June 17, continuing the 9th Session, the 15th National Assembly discussed in the hall the implementation of the socio -economic development plan, the state budget, thrift practice, anti-wastefulness and a number of other important contents.

One of the issues that has attracted much attention and heated debate is the situation of counterfeit, fake, poor quality goods and commercial fraud, especially in the e-commerce environment. Many National Assembly deputies expressed concern that fraud is becoming increasingly sophisticated, difficult to control and seriously affecting the economy, people's health and market confidence.

Delegate To Van Tam (Kon Tum delegation) cited data that in 2023, authorities discovered and handled more than 52,000 violations related to counterfeit and poor quality goods. In 2024, this number was more than 47,000 cases and in just the first 4 months of 2025, more than 34,000 cases were discovered and handled with a budget collection of more than 4,892 billion VND, criminal prosecution of 1,450 cases, involving more than 2,100 subjects.

"This shows that the production and trade of counterfeit goods, trade fraud, and smuggling have barely decreased and are becoming more complicated despite the efforts of authorities," said delegate To Van Tam.

Delegate To Van Tam said that counterfeit goods not only cause economic damage, threaten people's health and lives, and damage the reputation of legitimate businesses, but also hinder economic development, cause loss of state budget revenue, and cause social instability and the investment environment. This can be considered a national disaster that needs to be raised to a national level with appropriate and corresponding policies.

Delegates proposed that the Government and relevant agencies strengthen inspection and review of the performance of duties by relevant agencies, while promoting legal aid and legal consultancy activities, and enhancing legal education and propaganda so that people can understand and use this tool to protect their legitimate rights.

Also giving his opinion on this issue, delegate Le Huu Tri (Khanh Hoa delegation) suggested that there should be a strict legal framework to handle and publicize information so that people know and boycott counterfeit goods, especially fake drugs and dirty food.

Delegate Tri raised the issue: Although the legal system has covered many areas, many social management forces from the border, border gates, in residential areas, hundreds of tons of fake drugs, fake functional foods, fake foods and drinks are produced, circulated and traded. Therefore, there needs to be strict purges, detection and handling of law enforcement officers who cover up and tolerate crimes.

Clear legalization and decentralization

Explaining at the discussion session, Minister of Industry and Trade Nguyen Hong Dien frankly admitted that although ministries, branches and localities have made great efforts in the fight against counterfeit and poor quality goods and achieved some specific results, the situation is still very complicated.

According to the Minister, there are many main reasons leading to the above situation when the business of counterfeit goods is profitable, attracting many participants. Violations are increasingly sophisticated, taking advantage of high technology to commit fraud in the e-commerce environment.

In addition, the human and material resources of the authorities are still limited. Coordination between agencies is sometimes not synchronized. Current laws and sanctions are not deterrent enough. A number of officials are given responsibility but have degenerated and assisted in violations....

To overcome this situation, in the coming time, the Ministry of Industry and Trade will continue to advise on perfecting legal policies, clearly defining the authority and responsibility of ministries, localities, functional agencies and inter-sectoral coordination mechanisms, enhancing the effectiveness of supervision and inspection work, submitting to the National Assembly for consideration and approval of the Law on E-commerce to strengthen management of this field and is expected to be submitted in the upcoming 10th session.

At the same time, enhance responsibility for performing public duties, strengthen mandatory inspection and post-inspection, and perfect the support mechanism for local market management forces.

Minister Nguyen Hong Dien also said that the Ministry of Industry and Trade will propose to apply sanctions that are strong enough to deter violators. Promote dissemination and propaganda, guide businesses and business households to comply with the law and advise consumers to be smart consumers.

Regarding the handling of commercial fraud and counterfeit goods in the e-commerce environment, Minister Nguyen Hong Dien said that controlling and handling counterfeit goods in the online environment is always more difficult than traditional commerce, because the product range is complex, the technology is sophisticated, the inspection force and means are limited, and the coordination of many different specialized agencies is required.

Meanwhile, current laws do not have specific regulations on sanctions for new advertising sales models such as livestream or some other forms, and the sanctions are not really strong enough.

To overcome this situation, in the coming time, the Ministry of Industry and Trade will urgently complete the draft law on e-commerce to submit to the Government and the National Assembly. Accordingly, the Ministry of Industry and Trade proposes to clarify the responsibilities of local ministries, branches, and functional agencies with e-commerce models and livestream sales entities.

The Ministry of Industry and Trade will decentralize and delegate authority to localities in managing e-commerce transactions. Continue to coordinate with specialized units in inspecting and handling infringing goods, actively and proactively reviewing and handling the abuse of livestream and e-commerce application websites to trade in counterfeit, fake and poor quality goods.

Strengthen propaganda and dissemination to guide people and businesses to only buy products with clear origins and guaranteed quality. Strengthen data sharing connections between local ministries and sectors, coordinate with the National Steering Committee 389 and the Ministry of Public Security to exploit information, prevent counterfeit, fake, and poor quality goods, etc.
