Accordingly, the Inspector of the Department of Labor, Invalids and Social Affairs of Dong Nai province said that on September 10, 2024, he received a distress call from Mr. Van Ba Xuan, a former teacher and supervisor of Bui Thi Xuan Primary, Secondary and High School.
In the petition, Mr. Xuan reported that Bui Thi Xuan Secondary School did not pay him his full salary for June and July 2024, did not provide lunch, and did not fully pay social insurance, accident insurance, and health insurance as prescribed.
After studying the content of Mr. Xuan's petition, based on Clause 1, Article 15 and Article 19 of Decree No. 24/2018/ND-CP dated February 27, 2018 of the Government, regulating the settlement of complaints and denunciations in the fields of labor, vocationaleducation , activities of sending Vietnamese workers to work abroad under contracts, and occupational safety and hygiene, the Department Inspectorate determined that the content of the petition is under the first settlement authority of the employer.
The Inspectorate of the Department of Labor, Invalids and Social Affairs of Dong Nai province has requested Bui Thi Xuan Primary, Secondary and High School to base on the provisions of the 2019 Labor Code, the 2014 Law on Social Insurance, the implementing documents, as well as the agreements with the employees, to resolve the petition according to its authority. At the same time, the school must respond to the employees and report the settlement results in writing to the Inspectorate of the Department of Labor, Invalids and Social Affairs of Dong Nai province before October 30, 2024.
Previously, Kinh te & Do thi newspaper reported on the case of Mr. Van Ba Xuan, who has been a teacher and supervisor for 25 years at Bui Thi Xuan Primary, Secondary and High School. In a petition sent to the newspaper, Mr. Xuan said that he has been teaching and working as a supervisor and general supervisor for 25 years at the school, since its establishment until now.
“I work two shifts from 6:15 to 16:30, but the school cut lunch and reduced my salary from over 14 million VND/month to 11 million VND/month. This makes me very sad and affects my health,” Mr. Xuan shared.
In July 2024, Mr. Xuan met with Mr. Tran Thanh Xuan - the school owner, and the principal to explain that his social insurance payment period was only 22 years and 10 months, while he had worked for nearly 25 years. The insurance payment was too low, leading to many retired teachers receiving pensions that were not enough to live on. The school owner asked Mr. Xuan to submit a resignation letter and promised to settle the outstanding payments.
Mr. Xuan said that because he was upset, he wrote a resignation letter. In the letter, he asked the school to consider supporting him with 500 million VND, because the school had promised to consider supporting him if he submitted a resignation letter. After that, Mr. Xuan thought that he was at fault because his indignant information had attracted many comments, affecting the reputation and honor of the school. Because he missed his school and his students, he wrote a letter of apology and expressed his wish to return to work.
