Strengthening legal support for small and medium enterprises

Decree 55/2019/ND-CP dated June 24, 2019 of the Government detailing legal support for small and medium-sized enterprises (SMEs) is an important legal basis for local authorities to synchronously deploy solutions to improve the effectiveness of legal support for enterprises in general and SMEs in particular. In Ha Nam province, in recent times, authorities at all levels have focused on synchronously deploying many solutions, such as: issuing documents directing implementation; supporting information provision; supporting training and coaching; supporting administrative procedure settlement (TTHC); legal advice and answers... thereby playing a good role in supporting and accompanying businesses in development.

Currently, 1,057 legal documents (VBQPPL) (reaching 100%) issued by the People's Council and People's Committee of Ha Nam province have been updated on the National Database of Legal Documents. Policies and information related to investment activities are all made public on the electronic information portal of the Provincial People's Committee, the electronic information pages of departments, branches, and People's Committees of districts, towns, and cities. The content of the system of policies and information related to investment activities focuses on introducing and reflecting a number of key issues such as: Socio -economic information of the province (updated monthly, quarterly, 6 months, and annually); Overall map of planning projects approved by the Provincial People's Committee; Planning information, land use plans inside and outside industrial parks and industrial clusters; Annual land price list in the province; List and information of projects calling for investment in the province; Information on plans, programs, projects, and activities to support SMEs in the province; Incentive policies and investment support of the province; Legal documents of the Central and the province related to enterprises...

In addition, the Provincial People's Committee directed the Department of Justice to regularly introduce new legal documents, edit legal documents related to SMEs and post them on the province's Legal Dissemination andEducation website, to facilitate businesses in looking up documents and accessing information.

Aiming to support SMEs, in the period of 2019 - 2023, Ha Nam province organized 32 training courses, fostering legal knowledge and business management skills with a total of 3,000 participants. The content of the training courses focused on a number of topics such as: Starting a business; business strategy planning; human resource management, financial management; skills and management; disseminating the Enterprise Law, Investment Law and implementing documents; disseminating tax policies and laws, etc. Departments and branches in the province also organized 4 training courses on bidding and project management for about 400 students from enterprises providing bidding and project management consulting services... The Department of Justice, the Provincial Industrial Park Management Board coordinated with the Management Board of the interdisciplinary legal support program for enterprises in the period 2015-2020 (Ministry of Justice) to organize 10 conferences and training courses for SMEs in the province.

Mr. Nguyen Van Tinh, Director of the Provincial State Legal Aid Center, said: In 2023 alone, the Department of Justice actively coordinated with localities to organize 3 legal support conferences for businesses in Kim Bang district, Phu Ly city, Duy Tien town, attracting nearly 500 businesses to attend with the topic: Law on handling administrative violations related to production and business activities of enterprises, practices and issues to note. In particular, focusing on pointing out a number of administrative violations related to production and business activities of enterprises in the fields of: labor; social insurance; sending Vietnamese workers to work abroad under contracts; tax; environment; Issues that businesses need to pay attention to in complying with legal regulations on handling administrative violations... Through the conference, we aim to support and help businesses grasp some basic issues of the law on handling administrative violations to proactively prevent violations and protect their legitimate rights and interests in specific cases.

In addition, to facilitate enterprises in general and SMEs in particular when implementing administrative procedures, the Provincial People's Committee has directed departments, branches and sectors to regularly review and reduce the time for handling administrative procedures; support and guide the implementation of administrative procedures for SMEs. Thereby, the time for processing business registration dossiers has been reduced from 3 days to 1.5 days; the time for processing investment policy approval dossiers has been reduced from 32 days to 17 days; the time for processing investment registration certificate dossiers for projects has been reduced from 15 days to 6 days... Departments, branches and sectors, People's Committees of districts, towns and cities also regularly answer and provide legal support to SMEs through many forms such as: direct consultation; written answers; Organize dialogue conferences with businesses... The Provincial Industrial Parks Management Board has also arranged staff to be on duty and provide support to answer questions from businesses during the implementation of legal regulations related to businesses in industrial parks.

In addition to the achieved results, legal support for SMEs in the province is also facing some difficulties and problems. The legal document system in the fields of investment, land, construction, planning, etc. related to the production and business activities of enterprises still has shortcomings, some regulations are overlapping, contradictory, not suitable to reality, affecting the quality of legal support for enterprises. The team of civil servants performing legal support for enterprises mainly works part-time, has not been regularly trained in specialized skills, so their knowledge, skills and experience in specialized legal fields are limited. The effectiveness of legal advice by legal service organizations is still not meeting the needs of enterprises. The allocation of funds for legal support programs for SMEs is still limited. Regarding the beneficiaries of legal support - SMEs - there is still a situation where many businesses are mainly concerned with direct costs for production and business activities, and do not pay adequate attention to indirect costs (such as legal service costs, legal staff, etc.). The number of businesses proactively looking up and learning about the law on legal databases is still low.

Based on the above reality, in order for legal support for SMEs to be more effective, in the coming time, local authorities need to actively coordinate with departments, branches and sectors to synchronously deploy many solutions, focusing on innovating approaches and providing legal support for businesses; promoting the implementation of communication activities in a professional, appropriate and effective manner...
