Create conditions for people to access the law

To build communes and wards that meet legal access standards, the Department of Justice guides localities to improve the capacity of officials and civil servants; improve people's ability to access and awareness of law compliance, contributing to perfecting the criteria in building new rural areas.

According to Decision No. 25/2021/QD-TTg dated July 22, 2021 of the Prime Minister, the assessment of communes and wards meeting legal access standards is based on 5 criteria and 20 indicators; the criteria must achieve 80 points or more. Specifically, the 5 criteria include: Issuing documents under authority to organize and ensure the implementation of the Constitution and laws; receiving citizens, resolving petitions, complaints, denunciations, and administrative procedures; propagating and disseminating laws, grassroots mediation, legal aid, implementing democracy in communes and wards; ensuring security, order, and social safety. During the year, no officials or civil servants at the head of Party committees and authorities were disciplined or prosecuted for criminal liability for violating the law in the performance of official duties.

Building communes and wards that meet legal access standards is an important task in State management, and is also criterion 18.4 in the National Criteria for New Rural Areas. The Department of Justice has advised the Provincial People's Committee to issue a plan and documents guiding implementation in conjunction with the goal of building new rural areas in the 2021-2025 period; establishing an Evaluation Council, developing operating regulations and assigning tasks to members according to their functions and duties.

Ms. Lo Chau Thoa, Deputy Director of the Department of Justice, informed: The organization of assessment of communes and wards meeting legal access standards has changed when implementing 2-level local government. The organization of assessment according to Decision No. 25/2021/QD-TTg will be replaced by Decision No. 27/2025/QD-TTg dated August 4, 2025 of the Prime Minister. Accordingly, there are only 3 criteria including: Issuing legal documents; accessing information, disseminating and educating the law; mediation at the grassroots level. These are important regulations, aiming to strengthen the responsibility of grassroots authorities in organizing implementation, contributing to preserving socialist legality, exercising citizens' rights according to the provisions of the Constitution and laws.

Muong Sai commune was established on the basis of merging Nam Et and Muong Sai communes, both of which have met new rural standards. Mr. Lo Van Tam, Chairman of the Commune People's Committee, said: The commune has reviewed and maintained the legal access criteria, assigned judicial and civil status officials to advise on the implementation of each target; at the same time, promoted propaganda and legal education associated with the model of "Friendly government, serving the people". Plans and tasks are made public; the work of receiving people, resolving petitions, and conciliating at the grassroots level is associated with implementing democratic regulations, creating consensus among the people, limiting the occurrence of petitions beyond the level, and mass complaints.

In Muong Chien commune, the dissemination and popularization of legal education is carried out through village activities, loudspeakers, grassroots mediation... Every year, more than 60 propaganda sessions are organized, attracting more than 3,000 participants; 21 legal bookcases are maintained in the villages for people to consult. At the same time, the commune promotes administrative procedure reform, with 100% of files returned on time and before the deadline, ensuring citizens' rights when transacting.

Ms. Sung Thi Tang, Khau Pum village, Muong Chien commune, said: In the past 5 years, we have had access to the law through many channels such as direct propaganda, mass media, leaflets, documents... The village also has a legal bookcase for people to look up. Thanks to that, we have a firm grasp of the Party's guidelines and policies, the State's policies and laws, and actively participate in economic development.

To build communes and wards that meet legal access standards after operating under the new model, the Department of Justice is developing outlines, documents, legal situations and leaflets to serve the task of building communes and wards that meet legal access standards associated with building new rural areas and advanced new rural areas. At the same time, it continues to open specialized training courses and improve the capacity of civil servants directly performing this task.
