Previously, some investors made changes to technology plans during the operation of investment projects without reporting, without consideration, appraisal, or opinions from competent state agencies, leading to serious consequences for the environment and affecting people's health.

From this reality, the Law on Technology Transfer 2017 has a chapter regulating the technology appraisal of investment projects. Accordingly, the law stipulates the types of projects that must be appraised or have opinions on technology from competent state agencies; stipulates the authority to appraise or have opinions on technology...

At the forum on technology management policies serving socio-economic development, on the morning of September 30 in Hanoi, Dr. Nguyen Hoang Linh - Director of the Department of Technology Assessment, Appraisal and Inspection ( Ministry of Science and Technology ) said that recently issued legal documents have focused on more comprehensive regulations on appraisal and giving opinions on technology of investment projects.

Although this provision is in different legal documents, it has been researched and regulated to ensure consistency, avoid overlap and conflict between legal documents, and at the same time be suitable to the characteristics of each type of project and each source of investment capital.

From the business perspective, Ms. Nguyen Thi Van Anh - General Director of Chemical Industry Design Joint Stock Company (CECO) assessed that the appraisal or giving opinions on technology in particular is of great interest to management agencies, investors and businesses. The reason is that appraisal helps them make the right decisions in long-term investment in projects. Therefore, this activity plays a very important role in the socio -economy, serving many purposes for the parties involved.

However, according to Ms. Van Anh, in the work of appraising or giving technical opinions on investment projects, CECO found some difficulties and problems.

With the current large number of projects from all sources of capital, the huge amount of work while the lack of human resources and regular training will greatly affect the quality and progress of document appraisal.

"The Ministry of Science and Technology should take the lead in proposing to develop a training program for professional staff participating in appraisal work. On the other hand, it should develop mechanisms, policies, working regulations, and appropriate remuneration to both encourage professional staff to improve their qualifications and feel secure in performing their tasks, improving both the quality and quantity of appraisal work," the General Director of CECO suggested.

According to Ms. Van Anh, the State also needs to regularly update the list of new technologies, encourage transfer, limit and prohibit transfer in legal documents.

The current technology appraisal/opinion work is still governed by many legal documents such as the Law on Public Investment, the Investment Law, the Construction Law, etc., not to mention sub-law documents. This partly causes obstacles, overlaps, and different understandings for both investors and appraisal agencies in determining the correct subject and appraisal authority.

Technology appraisal or opinion is at the investment preparation stage, although the regulations on appraisal/opinion content at each stage are different.

"Going through two consecutive steps of technology appraisal/commentation during the project preparation stage is unreasonable, takes a lot of time and effort, and prolongs the project appraisal and approval process in general. At the same time, it also puts great pressure on the State agency responsible for receiving appraisal/commentation due to the large amount of investment and limited human resources," Ms. Van Anh reflected.

Therefore, CECO proposes that the management agency consider combining these two steps into one phase to reduce pressure on both investors and appraisal agencies.

In addition, the current regulations on technology appraisal/commentation are too detailed if evaluated at the investment project preparation stage, causing difficulties for investors.

"Regulations on appraisal/giving opinions on investment project technology need to soon have appropriate additional regulations to limit current legal shortcomings on this issue, ensure to enhance the sense of responsibility of individuals/appraisal councils, contribute to perfecting the law on project appraisal, towards the goal of sustainable development", CECO General Director proposed.

Meanwhile, Dr. Na Kyung Su - Head of Operation and Production Support Department of Hyosung Dong Nai Co., Ltd. proposed not to apply Clause 1, Article 14, Decree 69/2010/ND-CP to microorganisms imported to produce industrial chemicals using biotechnology.

"This will improve technical barriers to imports in Vietnam. This will allow Vietnam to take advantage of the world's leading advanced biotechnology more actively. This will be a very important point to develop the biotechnology industry in Vietnam more strongly in the future," said Mr. Na Kyung Su.

Mr. Mai Van Sung - Director of DC Center, Quality Measurement Standards Technical Center 3 (QUATEST3) proposed to review legal documents, amend the conditions for importing machinery, equipment, technological lines as well as criteria for determining technology when extending investment projects.

According to Mr. Sung, it is necessary to remove the regulations on age limits for machines, equipment, and technological lines. At the same time, it is necessary to issue instructions in cases where the capacity and consumption of raw materials cannot be determined, and to supplement the list of Vietnamese standards and regulations on safety, environmental protection, and minimum energy saving that must be complied with.
