Expanding land for commercial housing: Government clarifies types of land to be piloted
According to the Government, the Draft Resolution stipulates a pilot program for agricultural land groups, non-agricultural land groups that are not residential land, and cases where residential land and other land in the same plot of land are appropriate.

On November 7, the Government reported on the acceptance and explanation of the Conclusion of the National Assembly Standing Committee on the Draft Resolution of the National Assembly on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights (Draft).
Previously, in the submission dated October 29, the Government proposed that real estate business organizations be allowed to implement commercial housing projects through agreements on receiving land use rights or having land use rights that have changed the purpose of use for one or more types of agricultural land; non-agricultural land that is not residential land; residential land and other land in the same plot of land in the case of agreements on receiving land use rights.
Giving opinions at the meeting on November 3, the National Assembly Standing Committee proposed clarifying the basis and grounds for piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights for all types of land specified in Article 9 of the 2024 Land Law.
The Government explained that in reality, most new real estate development projects, especially large-scale projects, are implemented on land that is not originally residential land and the detailed planning of the project also includes many different types of land such as residential land, traffic land, green land, etc.
On the other hand, according to Article 9 of the 2024 Land Law, there are many specific types of land in the agricultural land group and non-agricultural land group. These types of land will be converted into residential land and other types of land within the scope of the project, so specifying each type of land and conditions for each type of land will easily lead to overlaps, conflicts, and difficulties in implementation.
Therefore, the draft Resolution stipulates a pilot program for agricultural land groups, non-agricultural land groups that are not residential land, and cases where residential land and other land are in the same plot of land, which is appropriate.
Ho Chi Minh City establishes working group to resolve the issuance of pink books for commercial housing projects
On November 5, the Ho Chi Minh City People's Committee issued Decision No. 5013/QD-UBND on the establishment of a Working Group to resolve issues related to the issuance of Certificates of land use rights and ownership of assets attached to land (also known as pink books) to organizations and individuals at commercial housing projects in the City.

The Working Group is headed by Mr. Nguyen Toan Thang, Director of the Department of Natural Resources and Environment of Ho Chi Minh City. Other members of the Working Group include other departments and branches such as the Department of Construction, Department of Planning and Architecture, City Inspectorate, City Police, etc.
The Working Group is responsible for reviewing and compiling statistics on housing areas and commercial housing projects in the City that have been granted investment and construction licenses and put into use but have not yet been granted pink books.
From there, clearly identify the causes and difficulties leading to the failure to complete the issuance of Certificates, group, classify, compile statistics, list specific projects by group, propose and implement solutions to remove obstacles and difficulties according to a specific plan, roadmap and time.
After that, advise the City People's Committee to direct consistently, uniformly and synchronously from the City to districts, Thu Duc City to resolve problems related to the issuance of Certificates to home buyers.
The Working Group is assigned to monitor, urge, inspect the progress of implementation, remove difficulties and obstacles, and comprehensively assess the development situation as well as the work of granting Certificates at commercial housing projects in the City from the time the project is granted an investment and construction license until the completion acceptance, putting into use and granting of Certificates.
According to the Department of Natural Resources and Environment of Ho Chi Minh City, as of early 2024, there are about 81,000 apartments in commercial housing projects in the city that have not been granted pink books.
The projects are divided into 6 groups: group waiting for tax; group of late submission of documents for granting pink books; group of new real estate; group of projects having to fulfill additional financial obligations; group of projects with other problems; group of projects under inspection and investigation.
Hoai Duc land auction "cools down", highest winning price is 103 million VND/m2
No more all-night bargaining, the auction of 20 plots of land LK01 and LK02 in Long Khuc area, Tien Yen commune, Hoai Duc district (Hanoi) ended at around 5 pm on November 4. The prices of the plots mostly fluctuated around 91 - 97 million VND/m2. Of which, the lowest priced plot was 85 million VND/m2; the highest was 103.3 million VND/m2.

The 20 lots auctioned this time are located opposite Tien Yen Kindergarten, about 400m from Ring Road 4 and right next to 19 lots LK03 and LK04 - the lots that once set a record for winning price in Hoai Duc district with 133 million VND/m2.
The two lots with the highest winning prices in this session are LK02-01 and LK01-04, with areas of 145 m2 and 109 m2 respectively. These are all corner lots, with 3 frontages and located at the "gateway" leading to the land. In other words, when people come to the Long Khuc auction land, they will almost certainly have to pass through the two lots above. This is the reason why these plots of land are 14 times more expensive than the starting price of 7.3 million VND/m2.
The last 32 plots of land in Long Khuc area, Hoai Duc district are about to be auctioned.
November 11 will be the time to hold the auction of 32 plots of land LK05 and LK06 in Long Khuc area, Tien Yen commune, Hoai Duc district. Most of the plots have an area of about 97 m2, with some plots as large as 144 - 172 m2.
The starting price for all plots of land is still 7.3 million VND/m2 – the same figure as previous auctions in Long Khuc area. The deposit for the plots ranges from 141 – 251 million VND/plot.

The upcoming auction lots have relatively nice locations. Both areas have a direct view of Ring Road 4 and are located right next to the lake. Lot LK05 will be next to the football field. Lot LK06 will be located next to the social housing project.
According to the announcement from Lac Viet Joint Stock Auction Company, the deadline for receiving registration documents to participate in the auction is November 8. The auction format is still direct voting in many rounds, at least 6 rounds. The common price step applied in all rounds is 6 million VND/m2.
Binh Dinh: Two land plots for a project worth over 2,200 billion VND are about to be auctioned.
The Property Auction Service Center (Department of Justice of Binh Dinh) recently announced the auction of land use rights to implement 2 projects including the Southwest urban area project of Nhon Ly commune and Project No. 2 (2-2), Nhon Ly - Cat Tien beach tourist area.
The Southwest urban area project of Nhon Ly commune belongs to the planning of Nhon Hoi tourist urban area (sub-area 03), Nhon Hoi economic zone, Nhon Ly commune, Quy Nhon city with an area of over 21.3 hectares (residential land 5.9 hectares, commercial service land over 1.7 hectares). The progress of completing the entire project is no more than 72 months from the date of the decision on land allocation and land lease.
The project has a total of 106 townhouses combined with commercial services, 229 villas, and 300 social housing apartments. In addition, the project also has a 9-storey hotel and a 3-storey auxiliary service building...
The Asset Auction Service Center said that the starting price of the asset is VND 537,436 billion, the step price is VND 10,749 billion, the deposit to participate in the auction is VND 107,487 billion. The time to submit the capacity profile and indirect bid form is before 4:00 p.m. on November 15, 2024; the auction will be held at 9:00 a.m. on November 23, 2024.
Meanwhile, Project No. 2 (2-2), Nhon Ly - Cat Tien beach tourist area has an area of 40.21 hectares including tourism service land of more than 14.4 hectares, hotel land of 1.6 hectares, resort service land of 1.1 hectares...
According to the Property Auction Service Center, the starting price of the property is VND 537.436 billion, the step price is VND 6.959 billion, the deposit to participate in the auction is more than VND 69.5 billion. The deadline for submitting documents is before 4:00 p.m., November 22, 2024; the auction time is 9:00 a.m., November 30, 2024.
Ninh Thuan separates residential land plots in Phan Rang - Thap Cham City, minimum 40 m2
The People's Committee of Ninh Thuan province has just issued regulations on conditions and minimum areas for land division and land consolidation for each type of land in the province.
Accordingly, regarding land division for residential land in urban areas, the People's Committee of Ninh Thuan province stipulates that the area of the newly formed land plot and the remaining area of the land plot after division must be at least 40 m2 (80 m2 in rural areas).

At the same time, the side size of the new plot of land formed by the division as well as of the remaining plot of land after the division must be greater than or equal to 3.5 m (in rural areas, it is 5 m).
In addition, the new land plot formed by subdivision and the remaining land plot after subdivision must be adjacent to a State-managed road or have access to a State-managed road.
Notably, the minimum land area allowed to be divided in existing coastal residential areas in Ca Na and Phuoc Diem communes of Thuan Nam district is also applied as in urban areas.
Along with that, the People's Committee of Ninh Thuan province also regulates the division of agricultural land (land for annual crops, land for perennial crops, land for aquaculture, land for salt production, other agricultural land and production forest land except production forest land that is natural forest) in urban and rural areas.
Specifically, in urban areas, the area of the newly formed land plot by subdivision and the remaining area of the land plot after subdivision in communes and wards of Phan Rang – Thap Cham city is at least 300 m2; in towns it is 500 m2.
In rural areas, the area of the newly formed land plot by subdivision and the remaining area of the land plot after subdivision must be at least 750 m2 in plain communes; 1,000 m2 in midland communes; and 2,000 m2 in mountainous communes.
Ninh Thuan Provincial People's Committee also noted that for residential land and non-agricultural land that is not residential land in areas with separate detailed construction planning projects, the minimum area to be divided into plots is according to the decision approving the detailed construction planning and the attached project documents approved by the competent state agency.
Thua Thien Hue strengthens management and prevents real estate price inflation
Thua Thien Hue Department of Construction said that Chairman of Thua Thien Hue Provincial People's Committee Nguyen Van Phuong signed and issued Directive No. 22/CT-UBND on strengthening the management and control of real estate price fluctuations in Thua Thien Hue province.
Accordingly, the Chairman of the People's Committee of Thua Thien Hue province requested departments, branches, sectors and localities to seriously and effectively implement legal regulations related to the real estate sector or coordinate with other agencies and units when requested. Continue to implement the Project to combat tax losses in real estate transfer transactions in Thua Thien Hue province until 2025 according to assigned functions and tasks.
The Chairman of the People's Committee of Thua Thien Hue province assigned the Provincial Police to coordinate with relevant authorities to inspect and supervise real estate transactions, ensuring compliance with the law. Detect and strictly handle acts of "price inflation" and real estate speculation, contributing to stabilizing the real estate market.
At the same time, the Department of Construction is assigned to preside over and coordinate with the Department of Planning and Investment, the Department of Natural Resources and Environment and the District People's Committees to inspect and review real estate business activities of enterprises, investors, real estate trading floors and real estate brokers in the province.
In addition, the Chairman of the People's Committee of Thua Thien Hue province also assigned the Department of Construction to coordinate with the Department of Natural Resources and Environment and the Department of Justice to organize inspections and checks, take measures to rectify acts of price inflation, price manipulation, speculation, and handle violations of land laws, real estate business laws and related laws (if any) within their authority.
