On the morning of November 1, discussing before the National Assembly the content of the assessment of the results of the implementation of the socio- economic development plan for 2023; the expected socio -economic development plan for 2024, National Assembly Delegate Hoang Duc Thang (Quang Tri delegation) raised the issue: The reality of the recent "mini apartment" fire in Thanh Xuan district, Hanoi was like the last straw of the long-standing accumulation of shortcomings. Therefore, it is necessary to solve this existing practical problem with appropriate technical measures. Tightening the management loopholes is an immediate task, but tightening it too much will push poor workers and students out onto the streets when they do not have the conditions to live in apartments that meet high requirements.

According to National Assembly Delegate Hoang Duc Thang, in recent times, we have tried to design many attractive policies to support investors in social housing projects, but very few businesses are interested, and home buyers cannot buy because of unsuitable prices, cumbersome procedures, and unsuitable locations. A "forest" of administrative regulations along with other legal risks are the fundamental reasons that discourage investors.
"It is necessary to immediately remove bottlenecks and consider social housing investment enterprises as special priority subjects so that the noble goal can become a reality," said National Assembly Delegate Hoang Duc Thang.
Speaking at the debate, Delegate Leo Thi Lich (Bac Giang delegation) acknowledged: "Creating conditions for low-income people to have accommodation, study and work is very necessary, but that does not mean loosening state management of infrastructure construction and urban management in residential areas, boarding houses, apartment buildings and not ensuring safety."
Delegate Leo Thi Lich also said that the granting of incorrect permits and violations of construction permit regulations for these houses needs to be strictly handled.

Regarding fire prevention and fighting, Delegate Leo Thi Lich said that through monitoring 65 rental facilities, most of them did not ensure fire prevention and fighting, but according to the report of the competent authority, there were no regulations on fire prevention and fighting for individual houses. Thus, it is necessary to regulate this issue. Therefore, the Delegate proposed to tighten management, clarify the responsibilities of the functional sector and amend the law in the near future.

The delegate pointed out the fact that there is a lack of legal corridor for the management of "mini apartments", loopholes in the legal system have led to loopholes in the management of "mini apartments".
According to Delegate Nguyen Thi Thuy, the current legal regulations on this type of housing are very loose, in which Clause 2, Article 46 of the current Housing Law devotes a section to describe this type of housing, but the standards, regulations, and management requirements are unclear, and even the identification is not really clear. Meanwhile, the whole society calls this product "mini apartments" - a term not in the law. Because of such loose regulations, there is a lack of appropriate legal corridors, causing confusion in management, putting pressure on urban infrastructure, and especially posing a high risk to people's safety.
It must be affirmed that the emergence of “mini apartments” in recent times has met the needs of many people with low-average incomes. Although when buying these apartments, people also feel the risk of insecurity, they believe that it will not happen and this further shows that the market is seriously lacking affordable housing products that suit the needs and budgets of the majority of workers.

Delegate Nguyen Thi Thuy expressed her strong agreement with the opinion of the National Assembly Chairman, affirming that the actual needs of the people must be guaranteed but definitely not legalizing the violations of "mini apartments" in the Housing Law.
From the above analysis, the female National Assembly delegate recommended that the Government continue to implement preferential solutions to unblock the supply of social housing and affordable commercial housing. The Government directed the agencies that are conducting inspections and examinations of "mini apartments" that, in addition to inspections to detect violations, it is necessary to provide timely guidance to people to have solutions to prevent fire and explosion safety; At the same time, it is recommended that the resolution of this National Assembly session include requirements on ensuring fire and explosion safety in general, including fire and explosion safety for existing "mini apartments".
