So, for some cars with windows above (sunroof), is it illegal to stick your head out to look while the car is running?
Article 4, Clause 5 of the Road Traffic Law on the principles of road traffic activities stipulates: Traffic participants must be self-aware, strictly comply with traffic rules, and ensure safety for themselves and others.
Vehicle owners and drivers are responsible before the law for ensuring the safety of vehicles participating in road traffic.
Currently, the law does not have specific regulations on penalties for the act of sticking your head out of a car sunroof while participating in traffic. However, by sticking your head out of a car sunroof, the car owner may still violate a number of other provisions of the Road Traffic Law.
Violation of Clause b, Article 68, Road Traffic Law on Passenger Transport by Car: Do not carry passengers on the roof, in the luggage compartment or let passengers hang or cling outside the vehicle.
Violation of Clause 23, Article 8 on traffic safety in the Road Traffic Law on prohibited acts: Acts violating road traffic rules, other acts that endanger people and vehicles participating in road traffic.
In addition, there is also a penalty for not wearing a seat belt (where seat belts are equipped) while the vehicle is moving.
Specifically, at point q, clause 3, Article 5 of Decree 100/2019, drivers of cars and similar vehicles who violate the law by carrying people in cars without wearing seat belts (in locations equipped with seat belts) while the car is running will be fined from 800,000 to 1 million VND.
Pursuant to Point b, Clause 6, Article 23 of Decree 100/2019, drivers of passenger cars, passenger vans and similar vehicles carrying passengers and people who violate the law by carrying people on the hood, roof or in the luggage compartment of the vehicle shall be fined from 3 million to 5 million VND.
In addition, at Point a, Clause 8, Article 23 of Decree 100/2019 (amended and supplemented by Decree 123/2021), the driver of the vehicle committing the violation shall also be subject to additional penalties of having his/her driving license revoked for a period of 01 to 03 months.
