Focus on decentralization
At the Hall, before voting to pass, National Assembly deputies listened to Chairman of the National Assembly's Law Committee Hoang Thanh Tung present a report explaining, accepting and revising the draft Law on the Capital (amended).
Based on the opinions of the National Assembly deputies, the draft Law has been reviewed and revised in the direction of regulating the organizational structure and tasks and powers of the authorities at all levels in Hanoi city, not only in accordance with the provisions of the Law on the Capital but also the provisions of the Law on Organization of Local Government; supplementing the authority of the Ward People's Committee in deciding on contents that, according to the provisions of other legal documents, must be decided by the People's Council at the commune level or must be approved by the People's Council at the commune level before deciding or submitting to competent authorities for consideration and decision.

Accordingly, the capital of the Socialist Republic of Vietnam is Hanoi. The capital is the national political and administrative center, where the central agencies of the Party, the State, socio-political organizations, diplomatic missions, and international organizations are headquartered; it is a centrally-governed city, a special-class urban area, and a major center of economics, culture, education, training, science and technology, and international integration of the whole country.
Regarding the organization of the government in Hanoi, the Law has ensured the organization of the capital's government in the direction of streamlining, professionalism, modernity, effective and efficient operation. Specifically, the Law stipulates that the local government in Hanoi city, districts, towns, cities under cities, communes and townships is the local government level consisting of the People's Council and the People's Committee; the local government in wards in Hanoi is the People's Committee of the ward. Thus, the Law has legalized the regulation of not organizing the People's Council at the ward level stipulated in Resolution No. 97/2019/QH14 of the National Assembly on piloting the organization of the urban government model in Hanoi city.
The Law on the Capital (amended) was passed, consisting of 7 Chapters with 54 Articles, clearly defining the position and role of the Capital; policies and responsibilities for building, developing, managing and protecting the Capital. The Law takes effect from January 1, 2025, except for the case specified in Clause 2, Article 54, which takes effect from July 1, 2025. |
Hanoi City elected 125 City People's Council delegates, of which at least 25% of the total number of delegates are full-time (an increase of 30 delegates compared to the present). The Hanoi City People's Council Standing Committee has no more than 11 members, including the Chairman, no more than 3 Vice Chairmen (an increase of 1 Vice Chairman and 4 members of the City People's Council Standing Committee). If according to the provisions of the Law, the City People's Council will have to increase more than 80 tasks and powers. Therefore, increasing the number of full-time delegates will add strength to the operating apparatus to continuously improve the effectiveness, efficiency and quality of the People's Councils at all levels, ensuring the substance and meeting the requirements and tasks of the new period.
The law also directly decentralizes power with the provision that during the time the City People's Council is not in session, the Standing Committee of the City People's Council decides on certain matters and reports to the City People's Council at the nearest session. This provision will help ensure urgency and timeliness in the management and operation process in the Capital.
At the same time, along with regulations on decentralization and delegation of authority between levels of government of Hanoi city, the draft Law has added regulations on decentralization and delegation of authority by the Government, Prime Minister, ministries and branches to agencies of Hanoi city to specify the policy of promoting decentralization and delegation of authority.

Also at the National Assembly, Member of the National Assembly Standing Committee, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that regarding policies on construction, development, management, protection of the Capital and mobilization of resources for the development of the Capital, the National Assembly Standing Committee has received and revised regulations on management and use of land at river banks and floating banks on diked rivers, ensuring compliance with planning and requirements for flood prevention and control.

Accordingly, the Law on the Capital stipulates the concentration of resources and priority given to the implementation of the zoning plan of the Red River and Duong River in accordance with the Capital Planning and the Capital General Planning. Hanoi City is allowed to build a cultural industrial center on the river banks, the Red River floating banks and other areas with advantages in terms of cultural space location in accordance with the planning.
In order to create a basis for implementing the policy of building Hanoi into a leading center for innovation, research, development, and technology transfer in the country and the region, the Law stipulates that public service units under the management of Hanoi city, public service units with facilities in Hoa Lac High-Tech Park (including public service units under the management of ministries and ministerial-level agencies) and the National Innovation Center are allowed to use public assets for business purposes, leasing, joint ventures, and associations in accordance with the functions and tasks of the unit.
Hanoi City is piloting the establishment of a Venture Capital Fund using the state budget to invest capital in high-tech enterprises, science and technology enterprises, and creative startups in key areas of science and technology of the city to support, promote innovation and commercialization of science and technology products. |
For Hoa Lac High-Tech Park, in addition to the mechanisms, preferential policies, and the highest investment support as prescribed, the Law also stipulates priority investment in the system of technical infrastructure works; high-tech technical infrastructure and infrastructure serving the development of science and technology in Hoa Lac High-Tech Park; compensation, support, resettlement; construction of accommodation in accordance with the planning to arrange for workers working in Hoa Lac High-Tech Park to rent during working hours.
The law allows investment in urban railway development in Hanoi to be prioritized to apply the TOD model, ensuring modernity, synchronization, and sustainability; in the TOD area, the city is allowed to collect and use 100% of the revenue from a number of revenues to reinvest in the construction of urban railways, public transport systems, and technical infrastructure connecting to the public passenger transport system.

The Law on the Capital (amended) determines that the State prioritizes investment and attraction of resources to promote the potential and strengths of the Capital to build, develop, manage and protect the Capital. In particular, in case the central budget increases revenue compared to the estimated revenue divided between the central budget and the Hanoi city budget, the central budget will allocate 30% of the increased revenue to reward the city budget.
Hanoi city budget enjoys 100% of the additional revenue from the adjustment of fee and charge policies to invest in developing economic and social infrastructure and spending on economic activities, science and technology, education, health, culture, sports and social welfare within the spending tasks of the city budget.
Hanoi City will give each household a national flag of the same design as the whole city on the occasion of the 70th anniversary of the Capital Liberation Day. |
On the afternoon of May 22, in Hanoi, the Hanoi Union of Friendship Organizations (HAUFO) coordinated with the Hanoi Youth Union to organize a training conference on the role of foreign affairs and people-to-people diplomacy in the new situation. The conference was attended by more than 300 officials and members representing departments, branches, friendship associations, HAUFO member organizations and union officials from colleges, universities and academies in the capital. |
