(MPI) - On the morning of September 13, 2024, at the headquarters of the Ministry of Planning and Investment , Deputy Minister Tran Quoc Phuong chaired a workshop to collect opinions from Development Partners on the draft Law on Public Investment (amended). The workshop was attended by development partners, international organizations, groups of development banks, embassies of several countries in Vietnam, and representatives of relevant units under the Ministry of Planning and Investment.

Speaking at the opening of the workshop, Deputy Minister Tran Quoc Phuong thanked the partners and sponsors for their effective cooperation and support in the process of Vietnam's socio -economic development. He also said that in order to carry out the assigned tasks, the Ministry of Planning and Investment has presided over and coordinated with relevant agencies to urgently develop the revised Law on Public Investment; and organized workshops to collect opinions from provinces and cities in regions.
According to Deputy Minister Tran Quoc Phuong, this is an important law project, affecting the country's socio-economic development, improving the efficiency of using state budget capital, creating a breakthrough in infrastructure development, and is one of Vietnam's important strategic breakthroughs.
In general, during the process of drafting the Law, the Ministry of Planning and Investment received many opinions from relevant parties on the contents, provisions, and policies expected to be amended; all opinions agreed and supported the innovative and breakthrough proposals in terms of thinking and policies in this Draft. The proposed contents are associated with major orientations to create innovation and greater efficiency in public investment management, continue to promote decentralization and delegation of authority associated with the reduction of administrative procedures; ensure that the proposed contents are highly feasible, associated with the effective allocation of resources, ensuring that they are consistent with the organizational capacity of each level and each agency; promote the flexibility and proactiveness of all levels and sectors in managing and implementing public investment plans; diversify forms and methods of project management and implementation; reform administrative procedures, shorten procedures to speed up project implementation progress; Institutionalize pilot and specific mechanisms and policies that have been allowed by the National Assembly to be applied to a number of localities, and through this time propose upgrading them in the Law for widespread application.
In addition, there are some contents that have been innovated to implement regulations clearly, transparently and more easily in the coming time. In particular, in this draft Law, the Ministry of Planning and Investment proposes to design a separate chapter to promote the implementation and disbursement of ODA capital and preferential loans from foreign donors for ODA projects, loans and aid projects to promote the implementation and disbursement of ODA capital and preferential loans from foreign donors.
To continue perfecting the Draft before submitting it to competent authorities and the National Assembly for consideration and approval at the 8th Session of the 15th National Assembly according to the 1-session process, Deputy Minister Tran Quoc Phuong requested that Partners consult and contribute frank and concise opinions, and make specific proposals and recommendations.

Presenting the contents of the draft revised Law on Public Investment, Mr. Tran Thanh Long, Deputy Director of the Department of National Economic Synthesis, Ministry of Planning and Investment, said that the draft Law is expected to consist of 07 chapters, 117 articles, focusing on 05 policy groups approved by the Government with 30 main policies. The Ministry of Planning and Investment has summarized, evaluated, and proposed amendments to the Law in the spirit of immediately removing difficulties, obstacles, and bottlenecks, promoting decentralization and delegation of power; enhancing the responsibility of leaders in implementation associated with improving enforcement capacity and strengthening inspection and supervision; fully analyzing the practical basis; purposes and requirements for drafting the Law; main amendments and supplements; transitional provisions, etc.
Regarding the policy groups to promote the implementation and disbursement of ODA capital and preferential loans from foreign donors expected to be added to this draft Law, Mr. Pham Hoang Mai, Director of the Foreign Economic Affairs Department, Ministry of Planning and Investment, said that the construction of a separate chapter to resolve difficulties and problems of ODA capital and preferential loan projects has been pointed out through working sessions with working groups on ODA capital disbursement of regions, ministries and branches as well as through comments from development partners.
Accordingly, the Draft supplements regulations to simplify the content related to Project Proposals; adds the activity of preparing Project Proposals to the investment preparation task and allocates capital for the task of preparing Project Proposals. Propose public investment programs and projects using ODA loans and preferential loans with the following main contents: Name of public investment program and project; Sponsor; Objective; Expected total ODA loans and preferential loans; Domestic financial mechanism (full allocation; partial re-lending; full re-lending); List of projects for public investment programs using ODA capital and preferential loans.
Decentralize authority, simplify procedures for approving and adjusting investment policies and investment decisions for projects using ODA capital; Simplify the implementation of projects using ODA non-refundable aid capital, speed up the approval of projects; Simplify the approval process for non-refundable aid projects; Supplement regulations on stopping the use of ODA capital at stages of programs and projects for programs and projects: approved investment decisions; approved investment policies; approved Program and project proposals. The draft supplements regulations to simplify the procedures for making medium-term and annual public investment plans.
Commenting at the workshop, partners highly appreciated the efforts of the Ministry of Planning and Investment in the process of drafting the revised Law on Public Investment as well as the support process to simplify procedures, creating favorable conditions for investors and partners; This draft proposes breakthrough policies, simplifies procedures, gives more power, reduces related time, especially in local governments. Comments also expressed confidence that with positive policy changes, potentials will be unlocked in the implementation of ODA projects.
In addition, opinions also focused on specific contents related to technical assistance projects without construction components; mixed projects with the participation and management of many different units but with the same goals; solutions to implement projects in many different fields, involving many ministries and branches; investment processes, procedures, and policies using non-refundable capital, simplifying investment procedures; allocating investment capital;...
Speaking at the end of the workshop, Deputy Minister Tran Quoc Phuong thanked the partners for their valuable comments on the Draft; basically, the comments supported the breakthrough new points of the Draft and contributed to the detailed contents and new proposals; affirmed that the Ministry of Planning and Investment, with an open-minded spirit, will study and absorb the comments in the process of perfecting the draft Law; continue to innovate strongly, especially the revised and supplemented contents not only aim to remove bottlenecks and limitations but also to unblock resources for the economy to achieve the set goals.
Deputy Minister Tran Quoc Phuong also clarified the contents raised by the delegates and said that the amendment of the Law on Public Investment this time is very comprehensive, with urgent progress, expected to be passed at the 8th session of the National Assembly. Therefore, the Ministry of Planning and Investment hopes to continue receiving comments, including from partners, in the process of building and completing the revised Law on Public Investment with the goal of continuing to institutionalize policies on public investment, removing difficulties, limitations, obstacles, bottlenecks, improving the efficiency of capital use, unlocking resources for development, creating favorable conditions for agencies and organizations in implementing the provisions of the law on public investment, creating favorable conditions for the implementation and disbursement of public investment capital, in order to meet the requirements of socio-economic development in the new period./.
