Construction permit exemption procedures for 112 projects in Ho Chi Minh City

The Ho Chi Minh City Department of Construction has just sent a notice to the People's Committees of communes and the Con Dao special zone about the proposal to reduce construction permit procedures for 112 individual housing projects in areas with detailed planning at a scale of 1/500 approved or accepted in accordance with regulations.

According to the announcement, in phase 1, Ho Chi Minh City has 112 projects that are eligible for construction permit exemption.

Accordingly, the Department of Construction will organize inspections of implementation and guide the People's Committees of wards and communes in Ho Chi Minh City to resolve difficulties and problems arising during the implementation process.

The People's Committees of communes in the former Ho Chi Minh City area will publicly post the list of projects within their administrative boundaries that are eligible for construction permit exemption; guide individuals and organizations to comply with approved planning and comply with legal regulations on construction commencement when receiving notice of construction commencement time.

The Department of Agriculture and Environment of Ho Chi Minh City is responsible for presiding over and coordinating with the City Land Registration Office to review current regulations, to guide the People's Committees of wards and communes in the old Ho Chi Minh City area to uniformly and synchronously implement the work of handling procedures for granting certificates of ownership of works for individual houses according to the lists announced by the Department of Construction.

Individuals and organizations with land in 112 projects exempted from construction permits must have legal documents on land with the purpose of using the land as residential land; construction must not be carried out if the land is in dispute or there is a decision preventing changes in the current status or transfer of assets by a competent authority and must have written consent from the bank (in case of mortgage). At the same time, design and construct individual houses in accordance with the architectural planning standards in the detailed planning at a scale of 1/500 approved or accepted by a competent state agency according to regulations. Send notice of the time of commencement of construction and construction design documents according to regulations to the local state management agency on construction at least 3 working days before the commencement of construction for management.
