As a member of the Government, the Prime Minister is responsible for explaining and answering questions from National Assembly deputies. The Prime Minister also represents the Government and authorizes Government members to sign Government documents.
On the afternoon of February 12, authorized by the Prime Minister, Minister of Home Affairs Pham Thi Thanh Tra presented to the National Assembly a report on the draft Law on Government Organization (amended).
According to the Minister of Home Affairs, the development of this Law aims to amend and supplement the regulations on the principles of organization and operation of the Government ; the tasks and powers of the Government, the Prime Minister and members of the Government, creating a legal basis for innovation and effective and efficient organization of the state administrative apparatus.
The law amendment also aims to promote decentralization and delegation of power, promoting the development of a constructive government.

Minister Pham Thi Thanh Tra said that one of the new points of the draft Law is the regulation on the tasks and powers of the Government (Article 10 of the draft Law). Accordingly, the Government unifies State management of sectors and fields.
The Government assigns the scope of State management to ministries and ministerial-level agencies; decentralizes authority to ministers and heads of ministerial-level agencies according to the scope of management, ensuring clear division of responsibilities of ministers and heads of ministerial-level agencies as members of the Government and heads of ministries and ministerial-level agencies.
The Government decides on policies for the development of sectors, regions and localities, except for policies under the decision-making authority of the National Assembly and local authorities. For issues that have been delegated to local authorities, local authorities shall proactively decide, organize implementation and be responsible for the results of the implementation of delegated tasks.
According to the draft Law, the Prime Minister is the head of the Government; leads the work of the Government and is responsible to the National Assembly for the activities of the Government and assigned tasks, ensuring the principle of not deciding on specific issues under the responsibility of ministers and heads of ministerial-level agencies in their capacity as members of the Government for the sectors and fields assigned to them.

Based on the principle of delimiting the Prime Minister's authority in Clause 3, Article 6 of the draft Law, the content of the Prime Minister's duties and powers is edited into the following groups: Content submitted to the National Assembly; Content submitted to the National Assembly Standing Committee; Content submitted to the President; Content under the Prime Minister's authority in leading, directing and operating the Government's activities. The Prime Minister does not decide on specific issues in State management of sectors and fields.
The draft Law also supplements and clearly defines the responsibilities of the Prime Minister.
Accordingly, as the head of the Government, the Prime Minister, on behalf of the Government, reports on the work of the Government and the Prime Minister to the National Assembly, the National Assembly Standing Committee, and the President. As a member of the Government, the Prime Minister is responsible for explaining and answering questions from National Assembly deputies. The Prime Minister also, on behalf of the Government or authorizing members of the Government, signs Government documents.

Examining the draft Law, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said he agreed with the addition of provisions on decentralization, delegation, and authorization to promptly institutionalize the Party's policy on implementing strong and reasonable decentralization and delegation between the Central and local levels.
According to the review agency, the contents on decentralization, delegation, and authorization shown in the draft Law on Organization of the Government (amended) and the draft Law on Organization of Local Government (amended) are closely related to each other and need to be further reviewed to ensure consistency and unity.
The draft Law on Organization of Local Government (amended) stipulates some contents on decentralization and delegation of authority that are different from the draft Law on Organization of the Government (amended). Therefore, the Law Committee recommends that the drafting agency continue to review to uniformly stipulate the subjects receiving decentralization at the local level and the general principles on decentralization and delegation of authority, ensuring the implementation of the policy of promoting decentralization and reasonable delegation of authority between the central and local levels.
The draft Law on Government Organization (amended) consists of 5 chapters and 32 articles (compared to the current Law, 2 chapters and 18 articles are reduced), and is expected to be considered and approved by the National Assembly at this extraordinary session.
