Concluding the conference reviewing three years of implementing Resolution No. 18-NQ/TW and one year of enforcing the 2024 Land Law, and proposing adjustments and additions to some contents of Resolution 18-NQ/TW as a basis for amending the 2024 Land Law, held on the morning of July 10th, Politburo member, Party Secretary, and Prime Minister Pham Minh Chinh stated that land is a difficult, sensitive, and complex issue; adjustments to policies and laws must be made with utmost care and a receptive attitude to ensure flexibility, effectiveness, and suitability to the situation.
The conference assessed that, after three years of implementing Resolution 18 and one year of enforcing the 2024 Land Law, land-related policies and laws have been implemented synchronously and yielded positive results. Specifically, the principle of "land belonging to the entire people, with the State acting as the representative owner and managing it uniformly" has been fully institutionalized, ensuring compliance with the Constitution; and the institutional framework, policies, and land use have been improved.
In addition, it is necessary to promote administrative reform, digital transformation, and improve the state management capacity in land; innovate and strengthen inspection, supervision, and handling of violations; resolve disputes, complaints, and denunciations related to land; and fundamentally address long-standing limitations and obstacles related to land management and use...
The delegates also frankly acknowledged that the understanding of the system of state ownership of land is still limited; land use planning and plans need to be adjusted to suit the two-tiered government model; issues related to land allocation, land leasing, permission to change land use purposes, land reclamation, compensation, support, and resettlement have encountered some difficulties; land prices do not clearly reflect the state's regulatory role... Therefore, it is necessary to adjust and supplement some contents as mentioned above in Resolution 18-NQ/TW as a basis for amending the Land Law in 2024.

During the discussion and clarification of the conference's contents and conclusions, Prime Minister Pham Minh Chinh basically agreed with and highly appreciated the opinions expressed by representatives of central ministries, departments, and localities, which were very practical, accurate, and closely followed the requirements. The speeches were heartfelt, responsible, focused, and demonstrated a high degree of unified concentration.
The Prime Minister stated that land issues are difficult, sensitive, and complex, requiring perseverance and steadfastness; he emphasized the importance of listening attentively and being receptive to the opinions of managers, scientists, citizens, and businesses; avoiding perfectionism and haste in the adjustment and supplementation process; and that what is mature, clear, proven correct by practice, and agreed upon by the majority should be supplemented and codified, ensuring flexibility, effectiveness, and suitability to the new situation.
With that perspective, the Prime Minister requested the lead agency to synthesize and unify a number of contents as a basis for agencies to supplement and finalize the dossier to be submitted to the Politburo. In particular, it affirmed that Resolution No. 18-NQ/TW of the 13th Central Committee is a political document of significant importance, serving as the political basis for further improving and effectively implementing land policies and laws in the future.
However, in the context of the new situation, especially to meet the requirements of rapid and sustainable national development in the new era, in line with the two-tiered local government model and the major policies and guidelines newly issued by the Party and State, it is necessary to adjust and supplement some viewpoints, tasks, and solutions in Resolution 18-NQ/TW.
Affirming that land is the property of the entire people; the State represents the owner and manages it uniformly, the Prime Minister suggested adding the viewpoint that: land is a special national resource, an important resource for national development; and that "land use rights are an important input for socio-economic development investment."

The Prime Minister directed the proposal to adjust and supplement several tasks and solutions regarding the continued improvement of institutions and policies for land management and use. This includes supplementing solutions on land use planning and plans, with simultaneous planning at the national, provincial, and commune levels; establishing mechanisms and solutions to address overlapping land use plans; prioritizing land allocation for the development of a comprehensive infrastructure system, industry, services, and urban development; maintaining a reasonable area of rice cultivation land to ensure national food security; and converting low-efficiency rice cultivation land to the production of other crops, livestock, or other uses to maximize land use efficiency and effectively exploit the unique potential, outstanding opportunities, and competitive advantages of each region and area.
The Prime Minister proposed supplementing solutions regarding land allocation, land leasing, and land-use conversion, such as: flexibly applying various approaches to land access when allocating and leasing land, in accordance with the type, nature, scale, and location of investment projects, ensuring a balance between the interests of the State, the people, and businesses; ensuring equality in land access between the public and private sectors; allowing land users to choose between annual land lease payments or a one-time payment for the entire lease period; and encouraging land users to choose annual land lease payments to ensure stable revenue for the budget.
The Prime Minister requested proposals for mechanisms to flexibly implement methods of land allocation and leasing for surplus land when reorganizing state-owned headquarters and facilities, and land recovered from the equitization and divestment of state-owned enterprises, to be converted to socio-economic development purposes, ensuring compliance with land use planning; and specific regulations on cases of land allocation and leasing without auctioning land use rights for this land fund.
Regarding solutions for land acquisition, compensation, support, and resettlement, Prime Minister Pham Minh Chinh requested the addition of content clearly stating that land acquisition must comply with the provisions of the Constitution and laws; it can only be carried out after the compensation, support, and resettlement plan has been approved, except in cases where land users agree to hand over the land.

The Prime Minister noted that in cases of land acquisition requiring resettlement, resettlement must be completed before land acquisition, except for urgent projects decided by competent authorities, projects implementing on-site resettlement within the project area, and projects where the resettlement area is arranged along the route of the main construction; the State has a policy of temporary housing for people whose land is acquired during the period before resettlement is arranged; the policy of separating compensation, support, and resettlement projects from investment projects should be implemented first; and the cases of land acquisition for socio-economic development, for national and public interest should be expanded.
The head of the government directed the proposal to adjust and supplement solutions on land prices and land finance in the following direction: Establishing mechanisms and methods for determining land prices based on market principles, with state control; the state determining land prices in the primary market when allocating land, leasing land, permitting land use conversion, and recognizing land use rights based on the land price list issued by the state, in accordance with the actual situation and land management requirements of the locality; regulating the rate of land use fee collection for different types of projects and the coefficient for deducting infrastructure costs when implementing projects; researching and proposing contents related to land with foreign elements...
The Prime Minister has instructed the Ministry of Agriculture and Environment, in coordination with the Government Office, to promptly incorporate the feedback and conclusions to finalize the draft Report, Submission, and Conclusion documents for submission to competent authorities, ensuring timeliness and quality.
