Concluding the Conference to evaluate 3 years of implementing Resolution No. 18-NQ/TW and 1 year of implementing the 2024 Land Law, proposing adjustments and supplements to a number of contents of Resolution 18-NQ/TW as a basis for amending the 2024 Land Law held on the morning of July 10, Politburo member, Party Secretary, Prime Minister Pham Minh Chinh said that land is a difficult, sensitive, and complicated issue; adjusting policies and laws must be very attentive and receptive to ensure adjustments and supplements are flexible, effective, and appropriate to the situation.
The conference assessed that after 3 years of implementing Resolution 18 and 1 year of implementing the 2024 Land Law, land laws and policies have been implemented synchronously, achieving positive results. In particular, fully institutionalizing the viewpoint that "land belongs to the entire people, with the State as the representative owner and unified management" ensures compliance with the provisions of the Constitution; perfecting institutions, policies and land use.
At the same time, promoting administrative reform, digital transformation and improving the capacity of state management of land; innovating and strengthening inspection, examination, supervision and handling of violations; resolving disputes, complaints and denunciations related to land; fundamentally resolving long-standing limitations and problems related to land management and use...
Delegates also frankly admitted that awareness of the regime of public ownership of land is still limited; land use planning and plans need to be adjusted to suit the two-level government model; issues related to land allocation, land lease, permission to change land use purposes, land recovery, compensation, support, and resettlement have arisen some problems; land prices have not clearly demonstrated the regulatory role of the state... Therefore, it is necessary to adjust and supplement some of the above contents in Resolution 18-NQ/TW as a basis for amending the Land Law in 2024.

Discussing and clarifying the contents and conclusions of the conference, Prime Minister Pham Minh Chinh basically agreed with and highly appreciated the opinions of representatives of central and local departments, ministries, branches, and localities, which were very close to reality, accurate, and closely followed the required content, expressed with enthusiasm, responsibility, and focus, demonstrating high concentration and unity.
The Prime Minister said that land is a difficult, sensitive, and complicated issue, so we must be persistent and steadfast; listen attentively and receptive to the opinions of managers, scientists, people, and businesses; not be perfectionist or hasty in the process of adjustment and supplementation; what is ripe, clear, proven correct in practice, and agreed by the majority, must be supplemented and legalized, ensuring flexibility, effectiveness, and suitability to the new situation.
With that viewpoint, the Prime Minister requested the presiding agency to synthesize and unify a number of contents as a basis for the agencies to supplement and complete the dossier to submit to the Politburo. In particular, it affirmed that Resolution No. 18-NQ/TW of the 13th Central Executive Committee is an important political document, a political basis for continuing to perfect and effectively implement land law policies in the coming time.
However, in the context of the new situation, especially to meet the requirements of rapid and sustainable national development in the new era, in accordance with the 2-level local government model and the major policies and guidelines of the Party and the State that have just been issued, it is necessary to adjust and supplement a number of viewpoints, tasks and solutions in Resolution 18-NQ/TW.
Affirming that land is owned by all people; the State represents the owner and manages it in a unified manner, the Prime Minister believes that it is necessary to add the viewpoint: land is a special national resource, an important resource for national development; "Land use rights are an important input factor for investment in socio-economic development."

The Prime Minister directed to propose adjustments and supplements to a number of tasks and solutions to continue perfecting institutions and policies on land management and use. In particular, adding solutions on land use planning and plans, with simultaneous establishment at national, provincial and communal levels; having mechanisms and solutions to handle overlapping issues between land use plans; prioritizing land allocation for the development of synchronous infrastructure systems, industry, services, and urban development; maintaining reasonable rice-growing land areas to ensure national food security, converting low-efficiency rice-growing land areas to the production of other crops and livestock or other purposes of use to maximize land use efficiency, effectively exploiting the potential differences, outstanding opportunities, and competitive advantages of each region and area.
The Prime Minister proposed to supplement solutions on land allocation, land lease, and land use conversion such as: Flexibly applying land access methods when implementing land allocation and land lease in accordance with the type, nature, scale, and location of investment projects, in order to harmonize the interests of the State, people, and enterprises; ensuring equality in land access between the public and private sectors; allowing land users to choose the form of land lease with annual payment or land lease with one-time payment for the entire lease period; encouraging land users to choose the form of land lease with annual payment to ensure a stable source of revenue for the budget.
The Prime Minister requested to propose a mechanism to flexibly implement methods of land allocation and land lease for surplus land funds when rearranging headquarters and state-owned working facilities, land recovered from equitization and divestment of state-owned enterprises to switch to socio-economic development purposes, ensuring compliance with land use planning; specifying cases of land allocation and land lease without auctioning land use rights for this land fund.
Regarding solutions for land recovery, compensation, support, and resettlement, Prime Minister Pham Minh Chinh requested additional content, clearly showing that land recovery must comply with the provisions of the Constitution and the law; and can only be carried out after the compensation, support, and resettlement plan is approved, except in cases where land users agree to hand over the site.

The Prime Minister noted that in cases of land recovery that require resettlement arrangements, resettlement arrangements must be completed before land recovery, except for urgent and urgent projects decided by competent authorities, projects implementing on-site resettlement within the scope of the project, projects in which resettlement areas are arranged along the route of the main works; the State has a policy of temporary residence for people whose land is recovered during the time when resettlement arrangements have not been made; implementing the policy of separating compensation, support and resettlement projects from investment projects to implement them first; expanding cases of land recovery for socio-economic development, for national and public interests.
The Head of the Government directed to propose adjustments and supplements to solutions on land prices and land finance in the direction of: Having mechanisms and methods to determine land prices according to market principles, with State control; The State decides on land prices in the primary market when allocating land, leasing land, allowing land use purpose conversion, recognizing land use rights based on the Land Price List issued by the State in accordance with the actual situation and land management requirements of the locality; regulating the land use fee collection rate for project types and the infrastructure cost deduction coefficient when implementing the project; studying and proposing contents related to land with foreign elements...
The Prime Minister assigned the Ministry of Agriculture and Environment to coordinate with the Government Office to promptly collect comments and conclusions to complete the draft documents of the Report, Submission, and Conclusion to submit to competent authorities to ensure time and quality./.
