(NLDO) - The Ministry of Education and Training stipulates that organizations and individuals who organize extra teaching and learning outside of school and collect money from students must register their business.
The Ministry of Education and Training (MOET) has just issued Circular No. 29/2024/TT-BGDDT regulating extra teaching and learning.

Accordingly, for extra teaching and learning in schools, the new Circular limits the subjects who are allowed to take extra classes in schools to 3 groups, including: Students whose study results of the last subject of the previous semester are not satisfactory; Students selected by the school to foster excellent students; Final year students who voluntarily register to review for entrance exams and graduation exams according to the school'seducation plan.
The new circular stipulates that teachers at schools are not allowed to teach extra classes outside of school and collect fees from students that the teacher is assigned to teach according to the school's educational plan. This regulation is intended to limit teachers from taking their students out to teach extra classes.
Regarding the cost of organizing extra teaching and learning: These 3 subjects are the responsibility of the school to train and are included in the content of the school's educational plan. No tuition is collected from students.
The Ministry of Education and Training stipulates that extra classes are arranged by subject for each grade; each class has no more than 45 students according to the regulations of the General School Charter. In one week, each subject has no more than 2 extra periods (to ensure that it does not exceed the average number of periods of subjects according to the regulations of the general education program). Do not arrange extra teaching hours interspersed with the timetable for implementing the main curriculum (to limit the negative effects of forcing students to take extra classes). Do not teach extra content ahead of the subject program distribution in the school's education plan.
Regulations on extra teaching and learning outside of school
According to the provisions of the new Circular, organizations and individuals organizing extra teaching and learning outside of school that collect fees from students must register their business to be subject to management under the provisions of the Enterprise Law.
Business organizations and individuals must also increase publicity on the electronic information portal of the tutoring facility or post at the tutoring facility information about the subjects that are organized for tutoring and learning; the duration of tutoring for each subject by grade level; the location, form, and time of organizing tutoring and learning; the list of tutors and the tuition fees before enrolling students in tutoring and learning classes to increase public supervision and the management of safety and security at the commune level for tutoring facilities.
The Circular increases the management responsibility of the Principal for teachers under his/her management when participating in extra-curricular teaching by stipulating: "Teachers currently teaching at schools who participate in extra-curricular teaching must report to the Principal about the subjects, location, form, and time of participation in extra-curricular teaching."
The amount of tuition collected outside of school is agreed upon between the parents, the student and the tutoring facility. The collection, management and use of tuition fees shall comply with the provisions of the law on finance, assets, accounting, taxes and other relevant regulations.
