Ho Chi Minh City still has about 100 projects waiting to pay land use fees.

(NLDO)- Ho Chi Minh City currently has about 100 real estate projects waiting for the State to announce land use fees and additional land use fees.

On the afternoon of October 3, Chairman of the Ho Chi Minh City People's Committee Nguyen Van Duoc and relevant departments and agencies had a meeting with the General Director of Lotte Properties HCMC Co., Ltd. (Korea). At the meeting, Lotte expressed its desire to continue implementing the Thu Thiem Eco Smart City project (An Khanh ward) if Ho Chi Minh City accompanies and resolves investment obstacles.

Chairman of the Ho Chi Minh City People's Committee Nguyen Van Duoc said that the city has acknowledged the business's recommendations and reported to the Central Government for consideration of appropriate solutions. The city's leaders welcomed Lotte's continued support, sharing difficulties and implementing the project on schedule.

Immediately after this information, the Ho Chi Minh City Real Estate Association (HoREA) sent a document to the Government , requesting "clarification of the legality related to the additional revenue as prescribed in Decree No. 103/2024/ND-CP regulating land use fees and land rents".

HoREA also sent a document requesting the National Assembly to add Article 11a after Article 11 to the "Draft Resolution stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law".

The content focuses on the regulation on "the amount of money that land users must pay in addition to the time that land use fees and land rents have not been calculated" but excludes cases that are not due to the fault of the land users. This proposal stems from the legal loophole in Point d, Clause 2, Article 257 of the 2024 Land Law, which only applies to "faulty" cases, ignoring the situation where the enterprise is innocent.

Lotte project in Thu Thiem Urban Area is attracting attention from investors.

According to Mr. Le Hoang Chau, Chairman of HoREA, currently Ho Chi Minh City has about 100 real estate and commercial housing projects "waiting" for notification of land use fees, additional land use fees (if any), along with additional payments for the delay. He cited some cases such as: 13 projects of Novaland , 8 projects of Hung Thinh Land, Empire City Observation Tower project of the joint venture of the Imperial City Joint Venture Company...

Mr. Chau emphasized that adding the provision of "additional payment, except in cases not due to the fault of the land user" will protect the legitimate rights of investors when policies change. This is not only reasonable but also has a positive impact on the investment environment, especially attracting foreign direct investment (FDI) into the real estate sector, an important economic growth driver of Vietnam.

According to HoREA, if the National Assembly approves, it is necessary to allow the deduction of the additional amount paid from the enterprise's other financial obligations to ensure fairness.

Regarding the collection rate, Clause 1, Article 50 and Clause 9, Article 51 of Decree 103/2024/ND-CP stipulates that the land use fee and land rent are calculated at 5.4% per year (according to Clause 2, Article 257 of the Land Law), which Mr. Chau commented is too high. Currently, the Ministry of Finance has reduced it to 3.6% per year, helping to reduce the burden on businesses.
