Accordingly, the use of roads and sidewalks for purposes other than traffic is carried out in accordance with the Law on Road Traffic Order and Safety and Decree No. 165/2024/ND-CP of the Government . This Decree specifically stipulates the cases of permitted use, conditions, documents, licensing authority; responsibilities of management agencies and related organizations and individuals. Violations will be handled in accordance with Decree No. 168/2024/ND-CP.
Regarding toll collection, Ho Chi Minh City is still applying Resolution No. 01/2018/NQ-HDND, Resolution No. 07/2020/NQ-HDND, Resolution No. 15/2023/NQ-HDND (formerly in Ho Chi Minh City) and Resolution No. 106/2019/NQ-HDND (formerly in Ba Ria - Vung Tau province). These resolutions are still in effect.

The Department of Construction also noted that, based on Decree No. 140/2025/ND-CP, the People's Committees at the commune level are responsible for reviewing, implementing management and handling violations related to the use of roads and sidewalks according to their authority. While waiting for the Ho Chi Minh City People's Committee to issue specific instructions on the management of road infrastructure assets, the Project Management Boards, Technical Infrastructure Management Centers and the People's Committees at the commune level need to coordinate to receive, guide and transfer documents to the Department of Construction for settlement, avoiding the situation of rejecting documents of people and businesses.
The Department of Construction requests relevant agencies and units to seriously implement and promptly report any difficulties or problems for consideration and resolution.
