The Ministry of Education and Training has just issued Circular No. 10/2025/TT-BGDDT regulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities for general education.
According to the Circular, the authority to manage extra teaching and learning activities in the area; guide and inspect the implementation of regulations on extra teaching and learning in the area; handle or recommend to competent authorities to handle violations; monitor and inspect compliance with legal regulations on working hours, overtime hours and legal regulations on security, order, safety, environmental sanitation, fire prevention and fighting of organizations and individuals providing extra teaching and learning outside of school as prescribed in Article 10 of Circular No. 29/2024/TT-BGDDT of the Minister ofEducation and Training promulgating regulations on extra teaching and learning is implemented by the People's Committee at the commune level.
Authority to transfer and admit junior high school students
The Circular clearly states that the authority to issue school transfer referral letters for junior high schools at Point f, Clause 1, Article 5 of the Regulations on school transfer and admission of students to junior high schools and high schools issued together with Decision No. 51/2002/QD-BGDDT is implemented by the Chairman of the People's Committee of the commune where the student goes.
The authority to receive, introduce to the school of residence, and check the documents specified in Point a, Clause 2, Article 5 and Clause 1, Article 11 of Decision No. 51/2002/QD-BGDDT is carried out by the People's Committee of the commune where the student is residing.
The authority to consider and decide on exceptional cases regarding school transfer time for junior high school level as prescribed in Clause 3, Article 5 of Decision No. 51/2002/QD-BGDDT is exercised by the Chairman of the People's Committee of the commune where the student arrives.
Organization of implementation of regulations on assessment of high school students
The authority to direct schools in the same area to accept and hand over student education results as prescribed in Clause 3, Article 12 of the Regulations on primary school student assessment issued together with Circular No. 27/2020/TT-BGDDT is implemented by the People's Committee at the commune level.
The authority to organize the assessment of primary school students in the area specified in Point a, Clause 1, Article 14 of Circular No. 27/2020/TT-BGDDT is implemented by the People's Committee at the commune level.
The authority to direct the principal to organize the implementation of assessment, acceptance, handover of educational results and monitor, inspect, and resolve difficulties and problems in the process of implementing primary school student assessment in the area specified in Clause 2 and Clause 3, Article 14 of Circular No. 27/2020/TT-BGDDT is implemented by the People's Committee at the commune level.
The authority to direct the organization of the assessment of junior high school students, direct and guide educational institutions to use the Student Monitoring and Assessment Book (by class), Student Monitoring and Assessment Book (of teachers), Student Report Cards; guide the use of electronic records, check and resolve difficulties in the process of implementing the regulations on assessment of junior high school students prescribed in Article 17 of Circular No. 22/2021/TT-BGDDT on assessment of junior high school students and high school students implemented by the People's Committee at the commune level.
Circular No. 10/2025/TT-BGDDT takes effect from July 1, 2025.
