On the afternoon of June 10, continuing the 46th session, the National Assembly Standing Committee gave opinions on receiving, explaining, and revising the draft Law amending and supplementing a number of articles of the Penal Code (amended).

Reporting at the meeting, Senior Lieutenant General Le Quoc Hung, Deputy Minister of Public Security, said that the Government found that the abolition of the death penalty for eight crimes as in the draft Law submitted to the 15th National Assembly at the 9th session is appropriate in the current conditions of our country, on the one hand still meeting the requirements of the fight against crime, while at the same time meeting the process of continuing to reduce the death penalty, as well as the requirements of cooperation and expansion of international relations for national development.
Particularly for the crimes of "embezzlement of property" and "bribery", after abolishing the death penalty, in order to ensure the recovery of assets obtained from crimes and at the same time encourage criminals to actively report during the process of resolving cases, the draft Law has amended and supplemented the provisions in the direction: "A person sentenced to life imprisonment for embezzlement of property or bribery can only be considered for a reduction in the term of serving the sentence if he has actively returned at least three-quarters of the embezzled or bribed property and during the investigation, prosecution and trial stages has actively cooperated with the authorities in detecting, investigating and handling crimes or has made great achievements".
Regarding the addition of the crime of "illegal use of narcotics" in the draft Law, the provisions of this article only deal with those who are in the process of drug addiction treatment or have just finished drug addiction treatment but continue to illegally use narcotics.
The draft Law also revises the regulations on the starting penalty for 3 crimes: Illegal production of narcotics, illegal transportation of narcotics and illegal trading of narcotics from 2 years in prison to 3 years in prison to ensure that it is commensurate with the nature and level of danger of the crime and is correlated with the starting penalty for the crime of illegal possession of narcotics, which is 3 years in prison.

Reporting on the reception, explanation and revision of the draft Law, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung said that the Supreme People's Court and the Supreme People's Procuracy proposed to retain the death penalty for three crimes: Illegally transporting drugs, embezzlement of property, and bribery; in addition, the Supreme People's Procuracy also proposed to retain the death penalty for the crime of espionage.
Regarding the two issues with different opinions on abolishing the death penalty for 8 crimes and adding the crime of illegal drug use, the Chairman of the National Assembly's Committee on Law and Justice said that the above two issues are important, which can lead to changes or have a major impact on criminal policy and the fight against crime, while the opinions of National Assembly deputies and agencies are still very different.
After the National Assembly Standing Committee discussed and concluded the session, Vice Chairman of the National Assembly Nguyen Khac Dinh said that the issue of abolishing the death penalty for 8 crimes and adding the crime of illegal drug use had been concluded by the competent authority. The National Assembly Standing Committee requested the Ministry of Public Security and the Committee on Law and Justice to coordinate in completing the draft Law with the highest quality, and submit it to the National Assembly for approval in the second phase of the 9th session.
