Why are illegal concrete pile casting factories not handled?

After the Gia Xuan Commune People's Committee illegally leased 1,100 square meters of land, a concrete pile casting station in Ninh Binh was built, affecting the lives of surrounding households.

According to the reflection of the people of Xuan Hoa village, Gia Xuan commune, Gia Vien district (Ninh Binh province), since the concrete pile casting workshop of Tan Phu Do Investment and Trading Company Limited (Tan Phu Do Company) started operating, it has caused noise and dust, affecting the lives of dozens of households.

Ms. Vu Thi Kieu (resident of Hamlet 2, Xuan Hoa village) said: Heavy trucks continuously enter and exit the concrete pile casting workshop, causing damage to the road, and people have to contribute to repair it. "We contributed money to build the road, but Tan Phu Do Company took advantage of it and then destroyed it all. In addition, since the workshop started operating, many houses have sunk and cracked, but the company has not cooperated or found the cause to come up with a solution," Ms. Kieu said.

From July 2021 to now, the people of Xuan Hoa village have submitted petitions 5 times, from the commune level to the district level and then to the Chairman of the Provincial People's Committee, Secretary of the Ninh Binh Provincial Party Committee, requesting measures to deal with the concrete pile casting workshop of Tan Phu Do Company. However, since then, the matter has not been resolved, making people very upset. The peak was on August 2, when Tan Phu Do Company continued to transport cranes, crawlers, and heavy trucks on the village road. Due to extreme frustration, the people blocked the company's vehicles, not allowing them to enter or exit.

According to the reporter's investigation, in August 2021, Gia Vien District People's Committee issued a document requesting the Chairman of Gia Xuan Commune People's Committee to terminate the land lease contract with Tan Phu Do Company. At the same time, the district requested the demolition of the construction, relocation of equipment for the production of concrete components and construction materials to return the land area leased by the commune in violation of the law. However, despite the direction of the District People's Committee, for the past 3 years, Gia Xuan Commune People's Committee has still allowed the concrete pile casting workshop to operate.

Mr. Bui Quang Canh - Chairman of Gia Xuan Commune People's Committee said: Since 2016, Tan Phu Do Company has been leased 1,100m2 of land by the Commune People's Committee in Xuan Hoa village to open a concrete pile casting workshop. By 2021, although the contract had been terminated, the workshop was still operating illegally and had not yet relocated. On October 9, 2024, Gia Vien District People's Committee established an inspection team to verify the above incident. On November 4, the District People's Committee issued Document No. 2458, directing the review, handling of responsibilities, and overcoming consequences in land management in Gia Xuan Commune.

Specifically, the area of ​​1,100m2 of land that Gia Xuan Commune People's Committee leased to Mr. Nguyen Ngoc Ha - Director of Tan Phu Do Company is rice land managed by the locality, not included in the concrete structure production planning. Mr. Ha (the land lessee) does not have an investment certificate, does not have a licensed concrete structure production project. On the area of ​​1,100m2 of land that Mr. Ha rented from the Commune People's Committee, many works have been built, machinery and equipment systems have been installed for production without a construction permit. The inspection team determined that Mr. Ha had illegally encroached and leveled the ground, built a 2-roof shed, a warehouse for materials, a porcupine cage, a pig cage, a chicken coop, an underground water tank, a surrounding wall...

Mr. Pham Van Tam - Chairman of Gia Vien District People's Committee said: The District People's Committee is directing the organization to review and clarify the responsibilities of collectives and individuals related to violations in land management at Gia Xuan Commune People's Committee in accordance with the provisions of law.
