Minister of Home Affairs Pham Thi Thanh Tra said that the amendment of the law aims to innovate the recruitment, use and management of civil servants according to job positions. The draft law clearly stipulates that the recruitment, arrangement and use of civil servants must be based on the requirements of the job position and the capacity and effectiveness of performing tasks, without conducting exams or considering promotion of professional titles as is currently the case.
Recruitment work is innovated in the direction of competitive examinations, public and equal recruitment, and at the same time allows public service units to proactively choose recruitment methods suitable for the industry and field of operation. The draft law expands the rights of civil servants, allowing them to sign professional contracts with other service units or non-public organizations; civil servants in the fields of science, technology and public higher education are allowed to contribute capital and participate in enterprise management to commercialize research results when approved by the head of the unit.
The bill also stipulates three groups of job positions including: management, professional and support positions; adds a multi-dimensional civil servant evaluation mechanism based on service quality and people's satisfaction, linked to screening of civil servants who do not meet requirements. The review report of the National Assembly 's Committee on Law and Justice approved the comprehensive amendment of the law, and at the same time proposed to clarify the specific provisions of the employment contract, and add the principle of unilateral termination of the contract to ensure the right to work of citizens.
