The Ministry of Construction has just sent a document to Project Management Board 7 to guide the contract award for construction packages of the Van Phong - Nha Trang section component project.
According to the Ministry of Construction, regulations on contract bonuses for construction packages under transport projects in the Socio -Economic Recovery and Development Program have been issued by the Government in Decree No. 15/2023/ND-CP dated April 25, 2023, regulating the pilot contract bonuses for construction packages under transport projects in the Socio-Economic Recovery and Development Program.
The determination of the source of bonus money and the method of calculating the bonus amount (based on the remaining amount after bidding, the shortened time ratio and the incentive coefficient) have been specifically regulated in Articles 4 and 5 of Decree No. 15/2023/ND-CP.
Accordingly, the remaining amount after bidding is the difference between the approved estimated package price (excluding contingency) and the winning bid price (excluding contingency).
The winning bid price is the price stated in the decision approving the contractor selection results as prescribed in Clause 3, Article 2 of Decree No. 24/2024/ND-CP dated February 27, 2024 of the Government detailing a number of articles and measures to implement the Law on Bidding on contractor selection.
“Project Management Board 7 shall base on the above regulations, regulations in the bidding documents, request documents, contents of the signed construction contract, results of contractor selection and actual implementation of construction packages to decide within its authority, ensuring compliance with legal regulations,” the official dispatch of the Ministry of Construction stated.
Regarding the determination of completed works and construction items, the Ministry of Construction stated that Article 3 of Decree No. 15/2023/ND-CP on reward principles stipulates: Works and construction items must be performed in accordance with the contract (in terms of quantity, volume, quality), meet technical standards and regulations and must be accepted and handed over in accordance with construction law.
However, Decree No. 15/2023/ND-CP does not yet have regulations on determining bonuses for each project item implemented by members of the contractor consortium. Therefore, the Ministry of Construction requests Project Management Board 7 to seek guidance from the Ministry of Finance as a basis for consideration and handling.
It is known that the Van Phong - Nha Trang section component project has a total length of 83.35 km; the starting point (Km285+000) connects the southern entrance road of Co Ma tunnel, located in Van Ninh district, Khanh Hoa province; the ending point (Km368+350) connects with the starting point of the Nha Trang - Cam Lam section component project.
The project has a total investment of VND 11,808.02 billion, using state budget capital and the Socio-Economic Recovery and Development Program, including 2 construction packages.
Package XL01: Construction of section Km285+000 - Km337+500, by the consortium including: Hai Dang Joint Stock Company constructing section Km285+000 - Km291+000; VNCN E&C Construction and Engineering Investment Joint Stock Company constructing section Km291+000 - Km298+000; LiZen Joint Stock Company constructing section Km298+000 - Km332+700; Phuong Thanh Construction Investment Joint Stock Company constructing section Km332+700 - Km337+500. Construction time to complete the project according to the contract is 1,020 days.
Package XL02: Construction of section Km337+500 - Km368+350, by the Vietnam Construction and Import-Export Joint Stock Corporation (Vinaconex) to construct section Km337+500 - Km345+620 and 6 bridges on the route; Son Hai Group Company Limited to construct section Km345+620 - Km368+350 and 8 bridges on the route. Construction time to complete the project according to the contract is 1,020 days.
According to the signed contract, Package XL01 will start construction on February 15, 2023 and be completed according to the contract on November 30, 2025; Package XL02 will start construction on January 11, 2023 and be completed according to the contract on October 26, 2025.
In response to the Prime Minister's request, all important national and key transport projects and works across the country must focus on shortening the progress and strive to complete them by the 50th anniversary of the Liberation of the South and National Reunification Day (April 30, 2025).
In fact, the Van Phong - Nha Trang section project has been completed and put into operation 70/83.35 km since April 19, 2025.
Of which, Package XL02 has been completed and handed over to the management unit to receive exploitation from April 18, 2025, shortening the progress by about 190 days compared to the contract.
The completion time of the XL01 package is shortened from 90 to 225 days, in which the 39.5 km long section Km298+000 - Km337+500 constructed by LiZen Joint Stock Company and Phuong Thanh Construction Investment Joint Stock Company is shortened by about 225 days compared to the contract.
The 13 km long section Km285+000 - Km298+000 (the remaining part of the package) constructed by Hai Dang Joint Stock Company and VNCN E&C Construction and Engineering Investment Joint Stock Company is about 70 days shorter than the contract.
Compared with relevant regulations, contractors of Package XL01 can be rewarded about 200 billion VND, while Package XL02 can be rewarded up to 370 billion VND.
This bonus, according to experts, is completely deserved, because the early operation of the Van Phong - Nha Trang expressway nearly 1 year has greatly contributed to regional transportation activities; vehicles circulate faster, safer, and more conveniently; investment efficiency is soon promoted and socio-economic development of the South Central Coast region is promoted.
