Commune-level cadres and civil servants are entitled to retain their salary and allowance policies and regimes when assigned to work at a new unit for a period of 6 months.

5 latest policies on commune-level cadres and civil servants that need attention

1. No distinction between commune-level cadres and civil servants, provincial and central levels

According to the latest regulations of the draft revised Law on Cadres and Civil Servants, communal-level cadres and civil servants will no longer be mentioned in this draft. Instead, there will only be the concept of cadres and civil servants in general.

At the same time, Article 46 of the draft revised Law on Cadres and Civil Servants also clearly states that commune-level cadres and civil servants who have been recruited and assigned according to the provisions of the 2008 Law on Cadres and Civil Servants, revised and supplemented in 2019, will be under the payroll of the province or centrally-run city.

According to the latest proposal of the Ministry of Home Affairs , it is expected that the system of cadres and civil servants will be managed uniformly from the central to local levels, without any distinction between communal, provincial or central level cadres and civil servants.

These subjects will be ranked in salary corresponding to the job position if they meet the required standards and conditions and are recruited, used and managed according to the general regulations of the Government . If they do not meet the standards and conditions of the job position, they will be considered and decided to be downsized.

2. Standards for commune-level civil servants after the merger

According to Decision 759/QD-TTg, the Prime Minister stated that, in the immediate future, the Ministry of Home Affairs will provide guidance on standards for local government officials and civil servants at the commune level. However, there are currently no specific regulations on this issue.

In addition, in the draft revised Law on Cadres and Civil Servants that is being consulted, the standards for commune-level cadres and civil servants after the merger will be consistent with the standards for cadres and civil servants to ensure the connection of the team of commune-level cadres and civil servants with the political system from the central to local levels.

Specifically, according to Article 22 of the draft, the conditions for registering for civil service recruitment will not discriminate against ethnicity, gender, social class, beliefs, or religion if the following conditions are met:

Have Vietnamese nationality; Age: 18 years or older; Have appropriate diplomas and certificates; have application form; Have clear background; have good political and moral qualities; Have good health to perform the task; Other conditions as required.

Not in the following cases: Not residing in Vietnam; losing/having limited civil act capacity; being prosecuted for criminal liability; serving/having completed serving a criminal sentence or decision without having the criminal record cleared; being subject to administrative measures of being sent to a compulsory drug rehabilitation facility or compulsory education facility.

3. Maintain the same number of employees after the merger

This content was also mentioned by the Prime Minister in Decision 759/QD-TTg. Specifically, because the commune-level administrative unit is larger than the current one and must ensure the implementation of all tasks and powers of the current district-level and commune-level local governments, in the immediate future:

Maintain the number of district-level cadres, civil servants, and public employees and commune-level cadres and civil servants before the arrangement to assign to new commune-level administrative units after the arrangement.

During the 5-year period, review and streamline the payroll in conjunction with restructuring and improving the quality of the team of cadres, civil servants and public employees at the commune level to meet task requirements.

The average is expected to be about 60 positions per commune level. The local provincial government decides on the specific number of positions for each commune level in the area based on the population size, natural area, and socio-economic development level of the commune-level administrative units to suit the reality.

This is also the content stated in Article 55 of the draft revised Law on Cadres and Civil Servants. Accordingly, the time to maintain the number of commune-level cadres and civil servants is implemented until the completion of the review, streamlining, restructuring and arrangement according to job positions of local authorities within a period of 5 years according to the approved job position project.

4. Many commune positions will no longer exist after the merger.

Also in Decision 759, the Prime Minister has proposed a policy to end the activities of non-professionals at the commune level. At the same time, consider and arrange for these people to work in villages and residential groups if they meet the requirements of the task. If it is not possible to arrange work according to regulations, then implement the retirement policy.

Currently, depending on each locality, each province arranges different non-professional positions. For example, in Hanoi, there will be 10 positions at the commune level that will no longer exist after the merger:

Office of the Commune Party Committee; In charge of commune-level broadcasting; Deputy Military Commander; Vice Chairman of the Fatherland Front; Vice Chairman of the Veterans Association; Vice Chairman of the Women's Union; Vice Chairman of the Farmers' Association (for communes and wards and towns with Farmers' Associations); Deputy Secretary of the Ho Chi Minh Communist Youth Union; Chairman of the Association of the Elderly; Chairman of the Red Cross Society in communes, wards and towns.

5. Retain salary until new job arrangement

Pursuant to Article 55 of the draft revised Law on Cadres and Civil Servants, commune-level cadres and civil servants will have their current salaries retained until they are assigned new jobs.

At the same time, in Decision 759, the Prime Minister also stated:

Preserve the current salary and position allowance regimes and policies (if any) of cadres and civil servants assigned to work at the new commune-level administrative unit after the reorganization for a period of 6 months. After this period, the salary and position allowance regimes and policies will be implemented in accordance with the new provisions of law.

Thus, the time to reserve the regime and policies after the arrangement is 6 months. After that, the regime and policies will be implemented as prescribed by law at that time.
