Applying special mechanisms in investing in Gia Binh International Airport

Accordingly, Resolution No. 3/2025/NQ-CP stipulates that the Gia Binh International Airport construction investment project is under the authority of the National Assembly to approve investment policies according to the provisions of the Investment Law; The Gia Binh International Airport construction investment project, the Gia Binh International Airport resettlement project, the Gia Binh International Airport construction investment project, the Gia Binh International Airport site clearance investment project, and the Gia Binh International Airport direct connection road investment project are implemented under the public-private partnership method.

Special mechanisms and policies on investment, construction, and investor selection
The Resolution clearly states that the projects specified above must carry out procedures for planning adjustment and construction commencement at the same time as carrying out procedures for investment policy approval.

Investors and project owners do not have to carry out procedures for granting construction permits according to the provisions of the law on construction; they are responsible for completing the conditions for starting construction of the projects specified above according to the provisions of law within 06 months from the date of commencement.
The Ministry of Public Security decides to select an investor to implement the Gia Binh International Airport construction investment project in the form of selecting an investor in special cases according to the provisions of the law on bidding before the National Assembly resolves to approve the investment policy.
At the same time, the Ministry of Public Security transfers the land area and invested construction items (hereinafter referred to as assets) of the Gia Binh Airport Construction Investment Project to the People's Committee of Bac Ninh province so that the People's Committee of Bac Ninh province can transfer these assets to the selected investor to implement the Gia Binh International Airport Construction Investment Project.
The investor implementing the Gia Binh Airport Construction Investment Project is responsible for reimbursing the expenses incurred by the Ministry of Public Security to the state budget in accordance with the law and the expenses incurred by the People's Committee of Bac Ninh province for land recovery, compensation, resettlement support, and the return of technical infrastructure and social infrastructure in accordance with the law.

Perspective of Gia Binh international airport.

The investment project to construct facilities to ensure flight operations at Gia Binh International Airport is implemented under the public-private partnership (PPP) method, Build-Transfer (BT) contract type, with payment to investors from state budget capital. The project does not have to implement an investment policy decision according to the provisions of the law on PPP. The allocation of state budget capital plans is implemented as prescribed for special public investment projects according to the provisions of the law on public investment. The selection of investors to implement the project is applied in the form of selecting investors in special cases and is determined in the project approval decision.
The Ministry of Public Security is the governing body and also the competent authority of the project, responsible for preparing the project, signing the project contract and balancing and arranging capital to pay the investor to implement the project according to the content of the signed BT contract.
The Ministry of Construction is responsible for coordinating with the Ministry of Public Security to ensure the technical standards and regulations of the Investment Project for the construction of works to ensure flight operations of Gia Binh International Airport and is the beneficiary of the assets resulting from the project implementation process in accordance with the provisions of law.
According to the Resolution, the following projects are implemented under the public-private partnership (PPP) method, Build-Transfer (BT) contract type, payment by land fund:
- Resettlement project serving Gia Binh International Airport;
- Investment project to construct works serving site clearance of Gia Binh International Airport;
- Investment project to build a road directly connecting Gia Binh International Airport.
The Resolution also states: The selection of investors to implement the above 3 projects is applied in the form of selecting investors in special cases and is determined in the project approval decision. The projects do not have to implement the investment policy decision according to the provisions of the law on PPP. The project approval decision is the basis for land allocation, land lease, and permission to change the land use purpose to implement the projects.
The People's Committee of Bac Ninh province is the competent authority of the projects, responsible for preparing the projects, deciding on the selection of investors, signing project contracts and balancing and arranging land funds to pay investors according to the signed BT Contract.

Special mechanisms and policies on planning, environment and land
The Resolution states: The approved master plan for the development of the national airport and seaport system for the 2021-2030 period, with a vision to 2050, and the Bac Ninh Provincial Planning for the 2021-2030 period, with a vision to 2050, approved by the Prime Minister, will be adjusted according to the simplified procedures and approval for adjustment as prescribed in Article 54a of the Law on Planning and will not be required to conduct a strategic environmental assessment.

Relevant technical and specialized planning is adjusted simultaneously with the adjustment of the Master Plan for the development of the national airport and seaport system for the period 2021 - 2030, with a vision to 2050, and the Bac Ninh Provincial Planning for the period 2021 - 2030, with a vision to 2050.
When preparing, appraising, accepting, approving, deciding on investment policies, approving projects that enjoy special policies and mechanisms as prescribed above, competent authorities are allowed to decide on contents different from the relevant planning and plans approved by competent authorities before carrying out procedures to adjust relevant planning and plans. After the project is approved, relevant planning and plans must be promptly reviewed, adjusted, updated and announced.
The People's Committee of Bac Ninh province shall base on the Planning of Gia Binh International Airport for the period 2021 - 2030, with a vision to 2050, the zoning plan or detailed plan of the projects (Resettlement project serving Gia Binh International Airport; Investment project to construct works serving site clearance of Gia Binh International Airport; Investment project to construct roads directly connecting Gia Binh International Airport) adjusted according to the above provisions to approve the compensation, support, resettlement plan and implement land recovery, compensation, support, resettlement, land allocation, land lease; use the rice-growing land quota according to the needs of the projects to carry out procedures for changing land use purposes.

This Resolution takes effect from August 14, 2025 until the projects enjoying special mechanisms and policies are completed.
