Issuing criteria for assessment and recognition of communes meeting legal access standards

The Decision stipulates 03 criteria for assessing and recognizing communes that meet legal access standards.

This Decision stipulates the purpose, principles, criteria, conditions, authority, order, procedures, and responsibilities of agencies and organizations in assessing and recognizing communes, wards, and special zones under provinces and centrally run cities (hereinafter referred to as commune level) that meet legal access standards.

The assessment and recognition of communes meeting legal access standards aims to evaluate the performance of commune-level authorities in the work of building and organizing law enforcement; promptly assess the practical situation and have solutions to overcome limitations and shortcomings, improve the effectiveness of commune-level authorities; raise awareness of understanding and complying with the law among people and businesses, contributing to building a culture of law compliance.

Criteria for access to law

The Decision stipulates 03 criteria for evaluating and recognizing communes that meet legal access standards, including:

Criterion 1 on promulgation of legal documents includes the following indicators:

1. Legal documents of the People's Council and People's Committee at the commune level are issued on time and in accordance with the provisions of law on promulgation of legal documents;

2. Draft legal documents of the People's Council and People's Committee at the commune level are communicated during the drafting process in accordance with the provisions of law on promulgation of legal documents;

3. Conduct self-inspection of legal documents of People's Councils and People's Committees at commune level according to the provisions of law on promulgation of legal documents.

Criterion 2 on access to information, dissemination and legal education includes the following indicators:

1. Establish, update, post (or post) the List of information that must be made public and the List of information that citizens can access under conditions according to the provisions of law on access to information;

2. Publicize legal documents of People's Councils and People's Committees at the commune level after promulgation in accordance with the provisions of law on access to information;

3. Provide information upon request in accordance with the provisions of law on access to information;

4. Issue and organize the implementation of annual plans for dissemination and legal education in accordance with the provisions of law on dissemination and legal education;

5. Implement digital transformation and apply digital technology in legal dissemination and education;

6. Ensure human and financial resources, facilities, and means to carry out legal dissemination and education work in accordance with the provisions of law on legal dissemination and education;

7. Information and introduction about legal aid according to the provisions of law on legal aid.

Criterion 3 on grassroots mediation includes the following indicators :

1. Establish and strengthen the mediation team and recognize the head of the mediation team and mediators according to the provisions of law on mediation at the grassroots level;

2. Conflicts, disputes, and law violations within the scope of grassroots mediation shall be promptly and effectively mediated in accordance with the provisions of law on grassroots mediation;

3. There is effective coordination and support from individuals and organizations in the area in implementing mediation work at the grassroots level;

4. Ensure human and financial resources, facilities, and means to carry out mediation work at the grassroots level in accordance with the provisions of law on mediation at the grassroots level.

Procedures for assessing, recognizing and publicizing communes that meet legal access standards

The Decision stipulates that the assessment and recognition of communes meeting legal access standards is carried out annually. The People's Committee at the commune level shall organize meetings to assess the implementation results and the level of achievement of each criterion and indicator of legal access; publicly post or post the self-assessment results for at least 10 days to collect opinions from agencies, organizations and individuals in the area; and submit the application for recognition of communes meeting legal access standards to the Department of Justice before November 25 of the assessment year.

Within 10 days from the date of receiving a complete and valid dossier, the Department of Justice shall organize an appraisal in an appropriate form, prepare a report on the results of the appraisal of the dossier and the level of legal access standards of each commune-level unit; submit it to the Chairman of the Provincial People's Committee for consideration and decision to recognize the commune level as meeting legal access standards.

The dossier requesting recognition of communes meeting legal access standards includes: Document requesting recognition of communes meeting legal access standards; self-assessment of the level of meeting legal access criteria and indicators; summary, acceptance and explanation of opinions of agencies, organizations and individuals on the results of self-assessment of the level of meeting legal access criteria and indicators (if any); minutes of the meeting requesting consideration and recognition of communes meeting legal access standards; documents proving the level of meeting legal access criteria and indicators.

No later than 05 working days from the date of the Decision on recognition of communes meeting legal access standards, the Provincial People's Committee shall post the results of recognition of communes meeting legal access standards on the Electronic Information Portal of the Provincial People's Committee;

No later than 05 working days from the date of receiving the Decision on recognition of commune-level meeting legal access standards, the People's Committee at the commune level shall post the Decision on recognition of commune-level meeting legal access standards at the headquarters of the People's Committee at the commune level, at the cultural house and community activity points in the village and residential group for at least 30 consecutive days; announce on the commune-level broadcasting system (if any) for at least 03 consecutive days and post on the portal (or Website) of the People's Committee at the commune level (if any).

This Decision takes effect from January 1, 2026.
