Ministry of Home Affairs orients job positions of commune-level civil servants

Regarding the organization, functions and tasks of specialized agencies under the People's Committees at the commune level, the Ministry of Home Affairs initially requested localities to continue to implement the Government's regulations in Decree No. 150/2025/ND-CP dated June 12, 2025 of the Government regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and People's Committees of communes, wards and special zones under provinces and centrally run cities and the instructions of the Ministries managing the sectors and fields that have just been issued.

Through the implementation and operation of the two-level local government, based on the recommendations and proposals of localities, to create initiative for localities in organizing specialized agencies under the People's Committees at the commune level to ensure that they are suitable for the scale of area, population, conditions, regional characteristics, and socio -economic development level of each commune-level administrative unit, in the coming time, the Ministry of Home Affairs will study, develop and report to competent authorities for the policy on decentralization for local authorities at the commune level to proactively decide to establish specialized departments or if not to establish specialized departments, to arrange commune-level civil servants according to sectors and fields to perform advisory functions, assisting the People's Committees at the commune level in state management of sectors and fields; criteria for establishing additional specialized departments for localities with complex and large-scale management requirements.

Regarding the Commune-level Public Administration Center, it is proposed to implement in accordance with Decree No. 118/2025/ND-CP dated June 9, 2025 of the Government on implementing administrative procedures under the one-stop, one-stop mechanism at the One-stop Department and the National Public Service Portal; the authority to establish is implemented in accordance with the guidance of the Government Office in Official Dispatch No. 7216/VPCP-KSTT dated August 4, 2025; localities with sufficient conditions are encouraged to implement the model of a one-level Public Administration Service Center, handling administrative procedures without boundaries.

At the same time, the Ministry of Home Affairs will coordinate with the Government Office to study and report to competent authorities to complete regulations on public administrative service activities for some commune-level areas with small scale and low service volume, where it is not necessary to maintain a specialized unit, a department of the People's Council Office and the People's Committee at the commune level will be arranged to perform this task.

Regarding the proposal of some localities on the arrangement of staff for the Commune-level Military Command, based on the provisions of the Law amending and supplementing a number of articles of 11 Laws on Military, the Chairman of the Provincial People's Committee decides to appoint the positions of commander and assistant of the Commune-level Military Command.

Accordingly, regarding the staffing of the Commune-level Military Command, it is recommended that localities, within their assigned authority, proactively balance and arrange staffing for the new Commune-level Military Command to perform military and defense tasks in the locality within the total staffing assigned by competent authorities.

Orientation of job positions for commune-level civil servants

Regarding the orientation of job positions for commune-level civil servants, based on the application of current guidance of ministries managing sectors and fields on job positions for civil servants of local authorities at all levels; functions, tasks, and powers of specialized departments under the People's Committees at the commune level and the expected orientation of the Government Steering Committee on temporary arrangement of staffing framework for commune-level administrative units, the Ministry of Home Affairs has had orientations on job positions for commune-level civil servants.

Mr. Vu Hai Nam, Director of the Department of Organization and Personnel (Ministry of Home Affairs) emphasized that this is a temporary job position. Accordingly, the Ministry of Home Affairs proposes to initially deploy the job position of commune-level civil servants in the following direction:

For the positions of civil servants in leadership and management at the commune level, there are expected to be 8 positions (Chief of Office of People's Council and People's Committee; Head of Department; Deputy Chief of Office of People's Council and People's Committee; Deputy Head of Department; Director of Public Administration Service Center; Deputy Director of Public Administration Service Center; Commander of Commune-level Military Command; Deputy Commander of Commune-level Military Command.

For commune-level civil servant positions, there are expected to be 20 positions, including: Office of the People's Council and People's Committee: 3 positions (corresponding to the fields: Office, justice, foreign affairs).

Economic Department (for communes and special zones)/Economic, Infrastructure and Urban Department (for wards and special zones in Phu Quoc): 7 positions (corresponding to the fields: Finance, planning, construction, transportation, industry and trade, agriculture, natural resources and environment).

Department of Culture and Society: 8 positions (corresponding to the fields: internal affairs; ethnic affairs, labor, education and training; culture, science, information; health).

Public Administration Service Center: 01 position, corresponding to the field of public administration service.

Commune Military Command: 01 position (Assistant to the Military Command).

Based on the workload of each group of tasks by sector and field, the People's Committee at the commune level arranges full-time or part-time civil servants to perform assigned tasks, ensuring compliance with the orientation of the civil servant payroll framework at the commune level according to regulations of competent authorities.

Previously, at the regular Government meeting in July, regarding the establishment of the payroll framework, Minister of Home Affairs Pham Thi Thanh Tra said that currently, the Ministry of Home Affairs is urgently developing a Decree on job positions, determining payroll for commune-level administrative units based on job positions, population size, natural area, specific factors and functions, tasks, and authority, avoiding the situation of "wearing the same shirt".

According to the Minister, in reality, some communes and wards may need hundreds of officials and civil servants, but there are also localities where only about 30 officials and civil servants are enough, such as communes that remain unchanged or small special zones.
