Reporting at the meeting, Mr. Mai The Toan - Deputy Director of the Vietnam Minerals Department said: On September 16, 2023, the Ministry of Natural Resources and Environment received Document No. 7120/VPCP-CN from the Government Office on the completion of the draft Decree amending and supplementing a number of articles of the Decrees in the field of minerals. In response to the comments of the Government Office in the above Document, the Ministry of Natural Resources and Environment coordinated with the Ministry of Justice to receive and clearly and fully explain the appraisal comments of the Ministry of Justice.
In order to carry out the tasks assigned by the Ministry of Natural Resources and Environment, the Vietnam Minerals Department has completed the draft Decree in the direction of only delimiting the scope of amendments and supplements to the provisions in the Decrees that are truly urgent and necessary to promptly remove difficulties and obstacles, promote production and business activities, develop and restore the economy , and must ensure that the amendments and supplements are within the Government's authority and in accordance with the law.
Previously, based on the appraisal report of the Ministry of Justice, the Ministry of Natural Resources and Environment has received and completed the draft Decree, accordingly the draft Decree has omitted the content of amending and supplementing Decree No. 36/2020/ND-CP of the Government regulating administrative sanctions in the field of water resources and minerals and some contents of Decree No. 158/2016/ND-CP of the Government detailing the implementation of a number of articles of the Law on Minerals, Decree No. 22/2012/ND-CP of the Government regulating the auction of mineral exploitation rights, Decree No. 67/2019/ND-CP of the Government regulating the method of calculation and collection of fees for granting mineral exploitation rights, Decree No. 23/2020/ND-CP of the Government regulating the management of sand and gravel in river beds and protection of river beds, banks and beaches, Decree No. 51/2021/ND-CP of the Government on mineral management in national mineral reserve areas and some other contents.
The Ministry of Natural Resources and Environment has also renamed the draft Decree to the Decree amending and supplementing a number of articles of the Decrees in the field of minerals. Regarding the contents that are requested to remain the same as the draft Decree, the Ministry of Natural Resources and Environment has clearly stated the legal basis, scientific basis and practical basis for amendment and supplementation.
At the same time, the Ministry of Natural Resources and Environment has reviewed all administrative procedures in the draft Decree and conducted a full impact assessment of administrative procedures in accordance with the Law on Promulgation of Legal Documents. The Department of Administrative Procedure Control has given specific comments on these administrative procedures.
For each of the above opinions, Deputy Minister Tran Quy Kien, together with leaders and representatives of the units: Vietnam Minerals Department, Vietnam Geology Department, Office of the National Mineral Reserves Assessment Council, and Legal Department, discussed and agreed to accept, partially accept, or keep the draft Decree.
Speaking at the meeting, Deputy Minister Tran Quy Kien requested the Vietnam Minerals Department to coordinate with relevant units, especially the Legal Department, to review each content and wording in the explanatory report, absorb the Government Office's opinions on the draft Decree amending and supplementing a number of articles of Decrees in the mineral sector, and strive to complete it soon so that the Ministry of Natural Resources and Environment can submit it to the Government in September as planned.
