The Standing Vice Chairman of the People's Committee of Khanh Hoa province, Le Huu Hoang, signed Decision No. 1261 dated May 15, 2025, on the revocation of the land plot at 28E Tran Phu Street, Vinh Nguyen Ward, Nha Trang City, for the reason of "recovering evidence according to the decision of the Khanh Hoa Provincial People's Court in Judgment No. 103/2023/HSST dated December 18, 2023; and of the Da Nang High People's Court in Judgment No. 579/2024/HS-PT dated November 28, 2024".

The land plot at 28E Tran Phu Street, covering 20,122.1 m² , comprises two adjacent plots of land previously managed and used by Khanh Hoa Power Corporation and the Rehabilitation Center under the Central Vietnam Power Corporation.
This plot of land is ideally located on one of the city's busiest streets, with a beachfront view.

In 2013, Nha Trang Golden Gate Co., Ltd. sent a letter to the People's Committee of Khanh Hoa province requesting approval for the investment location of the Nha Trang Golden Gate high-end hotel and tourist apartment complex project on the aforementioned land plot.
However, investigations have revealed that some officials in Khanh Hoa province violated the law in state management related to the selection of investors for the project, land acquisition, agreement on architectural and planning schemes for the project, land allocation, and land leasing for the 28E Tran Phu land plot.

The wrongdoings of the former officials included allowing Nha Trang Golden Peak Co., Ltd. to carry out a housing project without auctioning land use rights or bidding on the project... resulting in a loss of nearly 138 billion VND to the state budget.
At the first-instance trial on December 18, 2023, the Khanh Hoa Provincial People's Court ruled that the Khanh Hoa Provincial People's Committee should reclaim, manage, and use the entire land area at 28E Tran Phu Street in accordance with regulations.

On November 28, 2024, the High People's Court in Da Nang reviewed the case and upheld the first-instance judgment of the Khanh Hoa Provincial People's Court.
The reason is to avoid continued loss of state assets, waste of social resources, and increasingly severe damage due to the inability to exploit the benefits from the land plot for a long period. The land reclamation will also prevent the 발생 of complaints and grievances that could negatively impact the investment environment and local security and order.

According to observations by a reporter from SGGP Newspaper on May 20, 2025, the land plot at 28E Tran Phu Street is overgrown with weeds, and construction materials, iron, and steel are scattered haphazardly within the project site.

Some construction projects were left unfinished and then abandoned.

The project site is surrounded by fences, gates are closed, and security guards are on duty.

To carry out the land reclamation, the People's Committee of Khanh Hoa province assigned the Provincial Land Registration Office to revise the cadastral records and update the national land database in accordance with the law; and to revoke and cancel the Certificate of Land Use Rights, Ownership of Houses and Other Assets Attached to Land previously issued to Dinh Vang Nha Trang Co., Ltd. in accordance with regulations.

The Provincial People's Committee also assigned the Nha Trang City People's Committee to organize the land recovery on the ground, direct relevant units and localities to specifically determine the boundaries of the recovered land area, and assign the Khanh Hoa Land Fund Development Center to manage it; in case coercive measures are necessary, they should propose to the Provincial People's Committee to direct implementation in accordance with the law.
Regarding Nha Trang Golden Peak Co., Ltd., the People's Committee of Khanh Hoa province requests that the company handle the assets on the land and hand over the land and land use rights documents to the Provincial Land Fund Development Center for management in accordance with the law. If the company requests compensation or civil damages related to the reclaimed land, it may file a lawsuit for consideration and resolution.
