Participating in giving comments on the draft Law on Cultural Heritage (amended), delegate Phan Thai Binh (National Assembly Delegation of Quang Nam province) agreed with the establishment of a Cultural Heritage Conservation Fund according to Article 90 of the draft law.

However, to promote the values of cultural heritage, it is necessary to go hand in hand with the preservation, management and restoration of cultural heritage. Delegate Phan Thai Binh suggested that the current entrance fee collection should only be used to serve the management and promotion of the values of cultural heritage and not included in the state budget because the relics are the property of the people, the nature of the source of the entrance fee revenue to the relics is paid by tourists .

In reality, this source of entrance fee revenue is paid into the budget and is used to determine local budget revenue, balance regular expenditures and investment expenditures; it cannot be used to pay for cultural heritage protection and management activities according to the provisions of the Law on Cultural Heritage.

Discussing the draft Law amending and supplementing a number of articles of the Law on Pharmacy, delegate Duong Van Phuoc - Deputy Head of the National Assembly Delegation of Quang Nam province said that according to the report of the Department of Drug Administration, Vietnam has many pharmaceutical enterprises investing in modern production lines but still depends on raw materials from abroad. Currently, there are very few units producing raw materials to create pharmaceuticals; more than 90% of pharmaceutical raw materials must be imported, mainly from countries such as China, India, etc.

Therefore, in this amendment to the Pharmacy Law, delegates proposed to have a strong enough incentive policy to attract incentives for pharmaceutical ingredients to attract businesses and people to participate in investing in developing our country's pharmaceutical industry in the coming time.

Specifically, incentives on tax, land, credit and other guarantees on the ownership of capital, assets, and intellectual property of investors. There are special incentive mechanisms for mountainous areas and areas with special socio-economic difficulties; especially focusing on research on planting and developing concentrated medicinal raw materials, this is an advantage of Vietnam's diverse and available medicinal raw materials, avoiding the current situation of small-scale, fragmented, spontaneous planting that is difficult to control quality. Thereby, promoting the potential and experience in medical examination and treatment using traditional medicine methods as well as modernizing medicinal products of Vietnam.

The 2016 Pharmacy Law stipulates that “A person who has been granted a pharmacy practice certificate but does not practice for 12 consecutive months” will have his/her pharmacy practice certificate revoked. However, this amendment to the Pharmacy Law stipulates that “A person who has been granted a pharmacy practice certificate but does not practice one of the professional activities stated on the pharmacy practice certificate for 12 consecutive months” will have his/her pharmacy practice certificate revoked.

Delegate Duong Van Phuoc proposed to keep the 2016 Pharmacy Law unchanged or amend it more appropriately. Because in reality, many people who are granted pharmacy practice certificates do not perform one of the professional activities listed on the pharmacy practice certificate but have activities similar to retail pharmacy activities, or even have deeper expertise such as directly dispensing retail drugs in drug warehouses at hospitals and medical centers, their practice certificates will not be revoked, in order to ensure fairness and ensure the rights of people with pharmacy practice certificates.

Allowing the sale of drugs via e-commerce needs to be strictly controlled. The goal is for people to be able to buy drugs easily but safely, with a doctor's prescription and full pharmaceutical advice, for the right person, the right disease, and to be able to monitor adverse drug reactions.

To complete the above regulations, delegate Duong Van Phuoc suggested that the draft law must have stricter regulations on this new business method, carefully considering research, experience and practice in developed countries; legal and practical basis; assessing the benefits and risks, legal consequences of buying and selling drugs online, ensuring that the State manages and controls the above commercial transactions.
