On the afternoon of May 6, the 9th Session of the 15th National Assembly discussed the draft laws: Law on Science , Technology and Innovation; Law on amending and supplementing a number of articles of the Law on Product and Goods Quality and the draft Law on Atomic Energy (amended).

Participating in the discussion of the Draft Law on Atomic Energy (amended), delegate Duong Khac Mai, Deputy Head of the Specialized Delegation, Dak Nong National Assembly Delegation, said that the draft Law needs to clearly identify the subjects participating in activities in the field of atomic energy, and at the same time add state management activities so that the Law is scientific, easy to understand and consistent with the purpose, nature and content of the Law. Specifically, the scope of regulation should be stipulated as follows: "This Law regulates the activities of organizations and individuals in the field of atomic energy; ensures safety and security in such activities and regulates state management of the field of atomic energy".

In addition, at Point e, Clause 1, Article 7 of the draft Law stipulates: "Organizing the implementation of nuclear inspection activities according to the provisions of law and international treaties" which should be fully supplemented as follows: "Organizing the implementation of nuclear inspection activities according to the provisions of law and international treaties to which the Socialist Republic of Vietnam is a member" to ensure the accuracy of the Law as well as consistency and consistency with a number of specific provisions stipulated in the entire draft text.

Clause 4 of the draft Law states: “Production, purchase, sale, export, import of food, beverages, cosmetics, toys, jewelry, products, and other consumer goods with radioactive activity higher than the level prescribed by law”. According to delegate Mai, it should not be regulated in a list manner to avoid omissions, but should only be regulated in general as: “Production, purchase, sale, export, import of goods with radioactive activity higher than the level prescribed by law”.

Clause 10 of the draft Law mentions one of the prohibited acts as “Disclosing and misusing confidential information in the field of atomic energy”. Delegate Duong Khac Mai proposed to study and add the prohibited act of “Exploiting, disclosing and misusing confidential information in the field of atomic energy”. Because there are some subjects who do not have the duty or responsibility to hold information but somehow intentionally exploit the information holder or access the device to hold confidential information to disclose and trade news.

Clause 2, Article 11 of the draft Law stipulates: “The State has preferential policies to attract and employ highly qualified human resources and experts at home and abroad to work in the field of atomic energy; recruit students who have graduated from majors in the field of atomic energy with excellent or higher grades to work in state management agencies, training, research and application facilities of the State on atomic energy”. It is recommended to reconsider the regulation on determining “excellent students” and only stipulate in the direction of prioritizing the recruitment of excellent students, and recruitment must still go through entrance exams to have practical experience.

Point a, Clause 3, Article 21 states: “Organizations and individuals whose radioactive sources or nuclear materials are lost, appropriated or damaged must immediately report to the police agency, the state management agency for prevention and combat of proliferation of weapons of mass destruction, the nearest People's Committee and the nuclear regulatory agency; coordinate with relevant agencies, organizations and individuals to organize the search, recovery and handling of radiation and nuclear incidents regarding radioactive sources and nuclear materials and bear all related costs”.

Delegate Duong Khac Mai suggested reconsidering the case where the organization or individual whose radioactive source or nuclear material is appropriated or sabotaged must bear all related costs to organize the search, recovery and handling of radiation and nuclear incidents for radioactive sources and nuclear materials. In this case, it is necessary to clarify the responsibility of the person who appropriates or sabotages radioactive sources and nuclear materials. Compare with the Penal Code, from there determine the responsibility to compensate for radioactive sources and nuclear materials as well as the search costs. If the organization or individual whose radioactive source or nuclear material is appropriated or sabotaged bears all related costs, is it reasonable and fair in the case that they are the victims?
