Issuing and changing ID cards for citizens due to changes in administrative boundaries

Citizen: Currently, my citizen identification card shows an address in Binh Dinh province, but my household registration shows an address in Gia Lai province. My citizen identification card is not synchronized with national data. Now that Binh Dinh and Gia Lai provinces have merged into Gia Lai province, can I apply for a citizen identification card at Gia Lai Provincial Police and what are the procedures? I hope the Ministry of Public Security will guide me on what documents I need to bring?

The Ministry of Public Security responded as follows:

Pursuant to Point c, Clause 1, Article 26 of the Law on Residence, cases of change of place of residence in the Residence Database are due to adjustments in administrative unit boundaries, names of administrative units, names of streets, residential groups, hamlets, villages, hamlets, villages, villages, buon, phum, soc, and house numbering methods. The residence registration agency is responsible for adjusting and updating changes in information on citizens' residence.

Citizens' residence information in the Residence Database will be updated and synchronized with the National Population Database, the Identity Database, the electronic identification and authentication system (Electronic Identity).

In case a citizen needs to issue a new ID card due to a change in administrative boundaries, he/she must contact the Commune-level Police where he/she resides or the Provincial-level ID Management Agency where he/she resides to request the procedure for issuing a new ID card.

The order and procedures for issuing and exchanging ID cards are prescribed in Article 25 of the Law on Identification and Article 21 of Decree No. 70/2024/ND-CP dated June 25, 2024 of the Government detailing a number of articles and measures to implement the Law on Identification, specifically:

- Article 25 of the Law on Identification stipulates the procedures for issuing, changing and re-issuing identification cards, as follows:

“1. The order and procedures for re-issuing identity cards in the cases specified in Point b, Clause 2, Article 24 of this Law and for issuing and exchanging identity cards shall comply with the provisions of Article 23 of this Law.

2. In case of reissuance of ID card due to gender reassignment or gender transition or change or correction of information specified in Point b Clause 1 Article 24 of this Law, but such information has not been updated or adjusted in the National Population Database, the person requesting an ID card must present legally valid documents and papers proving the changed information to carry out the procedure of updating or adjusting information in the National Population Database.

3. The identification management agency shall collect used citizen identification cards and identification cards in cases of reissuance of identification cards.

4. The re-issuance of ID cards in the cases specified in Point a, Clause 2, Article 24 of this Law is carried out online on the public service portal, the national identification application or directly at the place where ID card issuance procedures are carried out. The ID management agency uses information on the most recently collected facial photo, fingerprint, iris and information available in the National Population Database and the ID Database to re-issue ID cards.

5. The Government shall detail this Article.”.

- Article 21 of Decree No. 70/2024/ND-CP dated June 25, 2024 of the Government stipulates the procedures for granting, changing and re-granting identity cards, as follows:

“1. Procedures for issuing, exchanging, and re-issuing ID cards at the ID management agency

a) Citizens come to the identification management agency specified in Clause 1 and Clause 2, Article 27 of the Law on Identification to request issuance, exchange, or re-issuance of an identification card, providing information including last name, middle name, birth name, personal identification number, and place of residence for the recipient to check and compare information in the National Population Database;

In case the person requesting the issuance, exchange or re-issuance of an ID card is the legal representative of a person under 14 years of age, the application for issuance, exchange or re-issuance of an ID card must have legal documents and papers proving that he/she is the legal representative of the person under 14 years of age;

b) In case the citizen's information in the National Population Database is not available or is incorrect, the recipient shall make adjustments to the information according to the provisions of Article 6 of this Decree before requesting the issuance, exchange or re-issuance of an identity card;

c) In case the citizen's information is correct, the person receiving the request for issuance, exchange or re-issuance of an ID card shall extract information about the citizen from the national population database. After determining that the information of the person requesting the issuance, exchange or re-issuance of an ID card is correct, the person shall carry out the procedures for issuing an ID card according to the provisions of Article 23 of the Law on Identification.

2. Procedures for issuing, exchanging, and reissuing ID cards through the National Public Service Portal, the Ministry of Public Security's Public Service Portal, and the national identification application

a) Citizens select procedures and check their information exploited in the National Population Database. If the information is correct, register the time and the identity management agency to perform the procedure. The system will confirm and automatically transfer the citizen's request to the identity management agency where the citizen requests to issue, exchange, or reissue an identity card;

Citizens come to the identification management agency at the registered time and place to carry out procedures for issuing, exchanging, and reissuing identification cards according to the order and procedures prescribed in Clause 1 of this Article;

b) In case of lost or damaged ID card that cannot be used, choose the re-issuance procedure and check your information exploited in the National Population Database. If the information is correct, confirm the transfer of the application for re-issuance of ID card to the ID management agency for consideration and settlement of the re-issuance of ID card according to the provisions of Clause 4, Article 25 of the Law on ID;

c) In case the legal representative carries out the procedures for issuing, exchanging, or reissuing an ID card for a person under 6 years old, he/she shall select the procedure and check the information of the person under 6 years old in the National Population Database. If the information is correct, the legal representative shall confirm the transfer of the application to the ID management agency for consideration and settlement of the issuance, exchange, or reissuance of the ID card.

3. In case of exchanging citizen identification card for ID card or exchanging ID card, the recipient is responsible for collecting the ID card, citizen identification card, or ID card in use.

4. In case a citizen does not come to the place to carry out procedures for issuance, exchange, or re-issuance of an ID card according to the time and place registered for an appointment with the ID management agency to carry out procedures for issuance, exchange, or re-issuance of an ID card, the system receiving the citizen's request will automatically cancel the citizen's registered appointment at the end of the working day. If the citizen continues to have a need to issue, exchange, or re-issue an ID card, he/she must register for another appointment.

5. The identification management agency shall organize the mobile reception of requests for issuance, exchange, and re-issuance of identification cards for Vietnamese citizens in the country and Vietnamese citizens abroad within its conditions and capabilities; ensuring compliance with the provisions of the Law on Identification, international treaties and international agreements to which Vietnam is a member.”.
