Hazard allowance for civil servants and public employees in the culture, sports and tourism sector

The Ministry of Culture, Sports and Tourism is drafting a Circular guiding the implementation of the hazardous and dangerous allowance regime for cadres, civil servants, public employees and workers in the culture, sports and tourism sector.

According to the draft, the subjects of application are cadres, civil servants, public employees, and workers at administrative agencies and public service units working directly in hazardous and toxic places where hazardous and toxic factors are higher than normal and have not been included in the salary coefficient.

Occupations and jobs that enjoy toxic and hazardous allowances

Level 1, coefficient 0.1 applies to cadres, civil servants, public employees, and workers doing the following jobs:

Operating, controlling, repairing radio transmitters with a capacity of less than 50KW; operating, controlling, repairing television transmitters, FM radio transmitters, microwave transmitters, operating satellite signal transmission stations with a capacity of less than 5KW; recording, editing in studios, editing rooms, recording studios, recording, editing, directing sound and images on radio and mobile television vehicles (mobile radio and television).

Coefficient level 0.1 applies to cadres, civil servants, public employees, and workers who operate, control, and repair television transmitters, and operate satellite signal transmission stations with a capacity of less than 5KW.

Operating, controlling, and repairing generators with capacity from 20KVA to under 500KVA; recording, dubbing, recording music, transmitting audio signals, television signals in studios; operating in the cable TV center's control room; managing film and tape warehouses, preserving and copying documents on magnetic tapes, video discs, audio discs, technical processing of archived documents, operating film projectors, repairing and restoring cinema films.

Reporters and editors organize the production of radio and television programs, direct and edit programs on mobile radio and television vehicles; announcers and editors host programs in studios and editing rooms.

Operate and control national radio and television broadcasting rooms; install and repair antenna feeder lines and antenna mast foundations at broadcasting stations with a total capacity of 100 KW or more; install, operate and repair power supply systems for radio and television stations and radio and television technical centers.

Level 2, coefficient 0.2 applies to cadres, civil servants, public employees, and workers doing the following jobs:

Occupations and jobs specified in the Working Conditions section, type IV, part XXVIII (Physical Education - Sports , Culture and Information) List of arduous, toxic, dangerous occupations and jobs and especially arduous, toxic, dangerous occupations and jobs (attached to Circular No. 11/2020/TT-BLDTBXH dated November 12, 2020).

Occupations and jobs specified in the section on Working conditions type IV, part XXXI ( Tourism ) List of arduous, toxic, dangerous occupations and jobs and especially arduous, toxic, dangerous occupations and jobs (attached to Circular No. 11/2020/TT-BLDTBXH dated November 12, 2020).

The following occupations and jobs: Operating, controlling, and repairing radio transmitters with a capacity of under 50KW, television transmitters, and microwave transmitters with a capacity of under 5KW placed in basements and cellars; operating and repairing refrigeration equipment in radio and television technical centers (central air conditioning); operating, controlling, and repairing FM transmitters, television transmitters, satellite signal transmission, and microwave transmitters in mountainous, border, and island areas.

Repair and maintain antenna columns, install signal transmitting and receiving equipment, and radiation antennas on antenna columns at heights of 50m to under 100m; operate, control, and repair generators with a capacity of over 500KVA to under 1000KVA; operate and repair generators with a capacity of 200KVA to 500KVA at a height of 1000m.

Measuring and testing frequency, capacity, quality of radio transmitters, television transmitters, amplifiers, standards of radio equipment; operating and controlling digital radio transmitters with capacity under 15KW, digital television transmitters with capacity under 5KW.

Level 3, coefficient 0.3 applies to cadres, civil servants, public employees, and workers doing the following jobs:

Occupations and jobs specified in the Working Conditions section, type V, part XXVIII (Physical Education - Sports, Culture and Information) List of arduous, toxic, dangerous occupations and jobs and especially arduous, toxic, dangerous occupations and jobs (attached to Circular No. 11/2020/TT-BLDTBXH dated November 12, 2020).

Occupation, job: Operating, controlling, repairing radio transmitters with a capacity from 50KW to under 200KW, FM radio transmitters, video transmitters with a capacity from 5KW to under 40KW; digital radio transmitters with a capacity from 15KW or more, up to under 50KW; operating, controlling digital video transmitters with a capacity of 5KW or more, digital radio transmitters with a capacity of 50KW or more; repairing, maintaining antenna poles, installing radiation antennas, signal transmitting and receiving equipment on antenna poles at a height from 100m to under 200m; installing, repairing, maintaining, welding optical cables of signal transmission systems and cable television.

Level 4, coefficient 0.4 applies to cadres, civil servants, public employees, and workers doing the following jobs:

Occupations and jobs specified in the section on Working conditions type VI, part XXVIII (Physical education - Sports, Culture and information) List of arduous, toxic, dangerous occupations and jobs and especially arduous, toxic, dangerous occupations and jobs (attached to Circular No. 11/2020/TT-BLDTBXH dated November 12, 2020).

Occupation, job: Operating, controlling and repairing television transmitters with a capacity of 40KW or more; operating and controlling radio transmitters with a capacity of 200KW or more, FM radio transmitters, television transmitters with a capacity of 10KW or more located at an altitude of 1000m or more; repairing and maintaining antenna poles, installing antennas, signal receiving and transmitting equipment on antenna poles at an altitude of over 200m; operating, controlling and repairing generators with a capacity of over 1000KVA.

How to calculate and pay allowances

The draft clearly states the calculation of allowances as follows:

Allowance level = Basic salary x Allowance coefficient

Hazardous and toxic allowances are calculated based on actual working time in places with hazardous and toxic factors. If working less than 4 hours a day, it is calculated as 1/2 working day, if working 4 hours or more, it is calculated as a whole working day.

Hazardous and hazardous allowances are paid with the monthly salary and are not used to calculate social insurance contributions and benefits.

In the engine room there are many generators of different capacities, the total capacity of the generators is the basis for calculating the allowance.

The Ministry of Culture, Sports and Tourism is soliciting comments on this draft on the Ministry's Information Portal.
